{"id":261029,"date":"2024-01-19T12:06:00","date_gmt":"2024-01-19T11:06:00","guid":{"rendered":"https:\/\/eshop.amenity.cz\/general-terms-and-conditions\/"},"modified":"2024-04-22T16:29:51","modified_gmt":"2024-04-22T14:29:51","slug":"general-terms-and-conditions","status":"publish","type":"page","link":"https:\/\/eshop.amenity.cz\/en\/general-terms-and-conditions\/","title":{"rendered":"General Terms and Conditions"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row full_width=&#8221;stretch_row_content_no_spaces&#8221; disable_element=&#8221;yes&#8221; bg_type=&#8221;bg_color&#8221; css=&#8221;.vc_custom_1710862177648{background-color: #ffffff !important;}&#8221; bg_color_value=&#8221;#ffffff&#8221;][vc_column][vc_column_text]<\/p>\n<p style=\"text-align: center;\"><strong><a href=\"http:\/\/amenity.cz\/en\/vop\/\">English<\/a> <\/strong>(General Business Terms and Conditions) <strong>\/ <a href=\"http:\/\/amenity.cz\/de\/vop\/\">Deutsch<\/a><\/strong> (Allgemeine Gesch\u00e4ftsbedingungen)<\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<\/p>\n<h1 style=\"text-align: center;\">General Terms and Conditions<\/h1>\n<p style=\"text-align: center;\"><strong>Article I.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Contractual relationship<\/strong><\/p>\n<p>These General Terms and Conditions of Business (hereinafter referred to as &#8220;GTC&#8221;) apply to the procedure for concluding an accommodation contract and regulate the general rights and obligations between the accommodated person (hereinafter referred to as the &#8220;Client&#8221;) and the operator of the individual Amenity Resorts operated by Amenity Resorts s.r.o, 276 50 626, with its registered office at Prague 4, Kunratice, Ratajova 1113\/8, Postal Code 148 00, registered in the Commercial Register, maintained by the Commercial Registry Office in Prague, Section C, Insert 121600 (hereinafter referred to as the &#8220;Accommodation Provider&#8221;), unless separate general terms and conditions are issued for specific accommodation facilities operated by the Accommodation Provider. The contractual relationship between the Accommodation Provider and the Client shall be governed by these GTC, the relevant accommodation contract concluded between the Accommodation Provider and the Client and in matters not expressly covered by the relevant provisions of the Civil Code and the relevant legislation. Provisions deviating from the GTC may be agreed in an individually concluded contract. Such deviating provisions in the individually concluded contract shall prevail over the provisions of the GTC. The individual provisions contained in the accommodation contract shall prevail over the provisions of these GTC. The accommodation provider reserves the right to include other terms and conditions in its offers that take precedence over these GTC. These GTC may be amended and changed by the accommodation provider in full and without limitation by electronic means. This provision does not affect the rights and obligations arising during the validity of the previous version of the GTC. In the event of such a change, the new version of the GTC will be placed on the website of the Accommodation Provider www.amenity.cz and sent to the Client, with whom the Booking process is in progress, without further notice. The amendment to these GTC shall become effective upon publication or delivery of the amended version to the Client. In the event of the Client&#8217;s disagreement with the published amendment to the GTC, the Client is obliged to communicate this disagreement in writing to the Accommodation Provider within two days of the delivery of the amendment to the GTC.<\/p>\n<p style=\"text-align: center;\"><strong>Article II.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Procedure for booking and conclusion of the accommodation contract<\/strong><\/p>\n<p>2.1 The Accommodation Provider offers accommodation and other related services (hereinafter referred to as &#8220;Accommodation&#8221;) to interested parties through its website www.amenity.cz and through approved intermediaries (hereinafter referred to as &#8220;Offer&#8221;). The Offer is binding on the terms and conditions and for the period set out therein, and the Accommodation Provider reserves the right to unilaterally change or specify the specific terms and conditions of the Offer. For the purposes of concluding the Accommodation Contract, the status of the Offer at the moment when the Client makes a reservation for Accommodation through the Accommodation Provider&#8217;s reservation system is decisive.<\/p>\n<p style=\"text-align: center;\"><strong>2.2 Reservation of Accommodation<\/strong><\/p>\n<p>Reservation of Accommodation is made via the electronic reservation form located on the website of the Accommodation Provider www.amenity.cz., or in any other way individually agreed with the Accommodation Provider. The reservation system offers several options for booking Accommodation, which differ according to the time of booking Accommodation, the method of payment and the amount of the price for Accommodation, payment and cancellation conditions. These are: (a) Non-refundable Reservation, (b) Reservation with cancellation, (c) Rate for 7 nights or more \u2013 non-refundable reservation or with cancellation (see Article III.GTC).<\/p>\n<p>The Client enters the basic requirements for the Accommodation (arrival date, departure date, number and status of persons) on the website of the Accommodation Provider www.amenity.cz, then enters the reservation system of the Accommodation Provider by clicking on the &#8220;Book&#8221; box, and then selects the reservation option for the desired type of Accommodation from the menu. In the next step, he\/she fills in the data in the booking form completely and truthfully (including the indication of the registration number and tax identification number and the request for a tax document, if required by the Client, in a note in the form), then confirms by ticking the appropriate box that he\/she has read and agrees to these GTC and the Personal Data Processing Policy (which are available to the Client by clicking on their name) and agrees to them. The same applies in the case of sending commercial communications to the Client by electronic means pursuant to Act No. 480\/2004 Coll. and processing personal data for these purposes (hereinafter referred to as &#8220;Reservation&#8221;). The Client shall be sufficiently notified of the existence of the GTC and the Personal Data Processing Policy and their wording prior to the actual execution of the Booking and shall have the opportunity to familiarize himself with them. The Client will not be allowed to complete the Booking without agreeing to the GTC and the Personal Data Processing Policy. The GTC and the Personal Data Processing Policy form an integral part of the contract.<\/p>\n<p>Before submitting a Booking, the Client has the opportunity to check the accuracy and completeness of the information in the Booking Form. The information provided in the submitted Booking is considered correct and binding, and no further or other changes are possible after the Booking has been submitted via the Booking Form. In the event that changes are required, the Client shall contact the reception of the respective resort where the Accommodation is provided. The Client submits the Reservation by clicking on the &#8220;Confirm Reservation&#8221; box.<\/p>\n<p>By sending the Reservation to the Accommodation Provider, the Client confirms that he\/she has fully read these GTC and accepts them as terms and conditions and an integral part of the accommodation contract.<\/p>\n<p>By submitting a Reservation, the Client expresses his\/her interest in concluding the Accommodation Contract.<\/p>\n<p>After submitting the Reservation, the Client is redirected to the payment gateway (see Article III. of the GTC) and pays the price of the Accommodation through the payment gateway, while the Client follows the instructions on the web interface. In the case of the Payment by Transfer option, the Client will receive a message from the Accommodation Provider immediately after sending the Reservation to the email specified in the Reservation containing payment instructions. Upon successful payment, the Client will receive a confirmation of receipt of the Booking containing a summary of the Booking and confirmation of payment.<\/p>\n<p style=\"text-align: center;\"><strong>2.3 Conclusion of the Accommodation Contract<\/strong><\/p>\n<p>The Accommodation Contract concluded between the Client and the Accommodation Provider, the subject of which is the provision of Accommodation according to the Reservation and\/or according to the agreement with the Accommodation Provider when arranging the Accommodation on the Check-in Date at the reception of the Resort in which the Client requests Accommodation (hereinafter referred to as &#8220;Accommodation Contract Conclusion at the Resort Reception&#8221;), is concluded in accordance with the legal regulations of the Czech Republic, in particular in accordance with Act No. 89\/2012 Coll, If the Client is a natural person who acts outside the scope of his\/her business activity or outside the scope of his\/her profession, the Accommodation Contract shall also be governed by Act No. 634\/1992 Coll., on Consumer Protection, as amended, in matters not covered by the GTC. The Accommodation Contract and the GTC are drawn up in the Czech language. The Purchase Contract may only be concluded in the Czech language, unless the Client and the Accommodation Provider agree otherwise. In such case, the interpretation of the Accommodation Contract in the Czech language shall apply in the event of a dispute over the interpretation of terms. The concluded Accommodation Contract shall be archived in electronic form with the Accommodation Provider, who shall give the Client access to it.<\/p>\n<p>The Client agrees to the use of remote means of communication for the conclusion of the Accommodation Contract. The costs incurred by the Client in using remote means of communication in connection with the conclusion of the Accommodation Contract do not differ from the basic rate of the provider of remote means of communication and are borne solely by the Client. The costs associated with making payment of the price of the Accommodation shall be borne by the Seller, with the possible exception of any excess payment chosen by the Client.<\/p>\n<p>The Client is obliged to pay the Accommodation Price set out in the Booking to the Accommodation Provider in the manner and under the terms and conditions of payment set out in these GTC (see this clause 2.3.1 and Article VI of the GTC). By entering into the Accommodation Contract between the Client and the Accommodation Provider, the Accommodation Provider undertakes to provide the Accommodation to the Client to the extent and under the terms and conditions set out in the Booking and these GTC.<\/p>\n<p>At the moment of payment of the total price of Accommodation according to the Reservation, the Client and the Accommodation Provider shall enter into an Accommodation Contract, which includes these GTC, for the accommodation and services specified in the Reservation sent by the Client or agreed upon at the Accommodation Contract at the reception of the Resort.<\/p>\n<p>2.4 If there are any typing or calculation errors (in particular, apparently unreasonable prices for accommodation and\/or services) or other misstatements or other discrepancies in the Offer, the Booking and\/or the Booking Confirmation, the Resort reserves the right to correct such errors or other discrepancies, which it will do itself or upon written request by the Client.<\/p>\n<p style=\"text-align: center;\"><strong>Article III.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Payment Terms<\/strong><\/p>\n<p>3.1 The payment terms and the due date of the Accommodation price vary depending on the choice of the Accommodation booking option, which varies according to the time from the date of booking the Accommodation to the agreed date of commencement of the Client&#8217;s use of the Accommodation (hereinafter referred to as the &#8220;Commencement Date&#8221;), the method of payment and the amount of the Accommodation price, payment and cancellation terms<\/p>\n<p>Non-refundable Reservation &#8211; the Client makes a Booking at any time before the Accommodation Commencement Date, the price of the Accommodation is paid by the Client in one lump sum in the amount of 100% of the price of the Accommodation, with payment being made on a cashless basis for the due date and payment of the price of the Accommodation:<\/p>\n<p>(a) online Payment Card via the Accommodation Provider&#8217;s reservation system in accordance with paragraph 2.2 of Article II. 2.2. of the Terms and Conditions, due on the date of the Booking, or<\/p>\n<ol>\n<li>b) in the case of Payment by Transfer, the Reservation must be made 4 days or more before the Check-in Date and the Client will receive a message from the Accommodation Provider immediately after the Reservation has been sent to the e-mail specified in the Reservation containing payment instructions. Payment shall be made by the Client in a single payment of 100% of the Accommodation Price, due within three (3) days of receipt of the Host&#8217;s payment instructions, and payment shall be made by bank transfer to the Host&#8217;s account specified in the payment instructions. Upon successful payment, the Client will receive a confirmation of receipt of the Booking containing a summary of the Booking and confirmation of payment.<\/li>\n<\/ol>\n<p>Reservation with cancellation &#8211; The Client makes a Reservation at any time prior to the Check-in Date, the price of the Accommodation is paid by the Client in one lump sum at 100% of the price of the Accommodation, with payment being made on a cashless basis for the due date and payment of the price of the Accommodation:<\/p>\n<p>(a) online Payment Card via the Accommodation Provider&#8217;s reservation system in accordance with paragraph 2.2 of Article II. 2.2. of the Terms and Conditions, due on the date of the Booking, or<\/p>\n<ol>\n<li>b) in the case of Payment by Transfer, the Reservation must be made 4 days or more before the Check-in Date and the Client will receive a message from the Accommodation Provider immediately after the Reservation has been sent to the e-mail specified in the Reservation containing payment instructions. Payment shall be made by the Client in a single payment of 100% of the Accommodation Price, due within three (3) days of receipt of the Host&#8217;s payment instructions, and payment shall be made by bank transfer to the Host&#8217;s account specified in the payment instructions. Upon successful payment, the Client will receive a confirmation of receipt of the Booking containing a summary of the Booking and confirmation of payment.<\/li>\n<\/ol>\n<p>Rate of 7 nights or more Non-refundable or Cancellation &#8211; The Client makes a Booking at any time prior to the Check-in Date, the price of the Accommodation is paid by the Client in one lump sum at 100% of the price of the Accommodation, and payment is due and payable on a cashless basis:<\/p>\n<p>(a) online Payment Card via the Accommodation Provider&#8217;s reservation system in accordance with paragraph 2.2 of Article II. 2.2. of the Terms and Conditions, due on the date of the Booking, or<\/p>\n<ol>\n<li>b) in the case of Payment by Transfer, the Reservation must be made 4 days or more before the Check-in Date and the Client will receive a message from the Accommodation Provider immediately after the Reservation has been sent to the e-mail specified in the Reservation containing payment instructions. Payment shall be made by the Client in a single payment of 100% of the Accommodation Price, due within three (3) days of receipt of the Host&#8217;s payment instructions, and payment shall be made by bank transfer to the Host&#8217;s account specified in the payment instructions. Upon successful payment, the Client will receive a confirmation of receipt of the Booking containing a summary of the Booking and confirmation of payment.<\/li>\n<\/ol>\n<p>Group bookings &#8211; the Client (Company) confirms the Booking based on the Offer received from the Host&#8217;s sales department by the deadline included in the Offer by email to events@amenity.cz. The price of the Accommodation is paid by the Client by Advance Invoice in the amount of 100% of the price of the Accommodation with a due date of 14 days, unless otherwise agreed with the Host&#8217;s sales department. After the event has taken place, the Client shall be invoiced for the remainder of the services provided based on the scope agreed by both parties in advance and a Final Invoice shall be issued with a due date of 14 days, unless otherwise agreed with the Accommodation Provider&#8217;s sales department.<\/p>\n<p>3.3 Payment of the price of the Accommodation shall be deemed to be the crediting of the relevant amount to the bank account of the Accommodation Provider at the time it is due.<\/p>\n<p style=\"text-align: center;\"><strong>Article IV.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Price<\/strong><\/p>\n<p>4.1 The price of Accommodation means the price stated in the Reservation and\/or in the Offer current on the Accommodation Arrival Date, if the Accommodation Contract is concluded at the reception desk of the Resort, as the price for the agreed accommodation and services (i.e. the price of accommodation in the respective facility for the agreed number of persons, meals, additional services, wellness services, pet stay, etc.), including taxes and any discounts. Vacation fees are not included in the price of the Accommodation and will be paid on the day of arrival at the reception of the resort. Holiday fees are payable by every adult over 18 years of age and are based on the place of stay and the number of nights booked, and are subject to change as decided by the local authorities.<\/p>\n<p>4.2 The Landlord is not entitled to unilaterally increase the price of the Accommodation during the period of validity of the Reservation, except in the following cases:<\/p>\n<p>&#8211; if there is a change in the Reservation (e.g. change of the property or date, number of persons, etc.),<\/p>\n<p>&#8211; if the Client fails to prove or prove that the conditions for granting the claimed discount have been met,<\/p>\n<p>&#8211; if there is a change in legislation or in the rates of value added tax.<\/p>\n<p>4.3 The Client is entitled to a discount on the price of Accommodation if, at the latest when sending the Reservation, or when concluding the Accommodation Contract at the reception of the Resort on the Accommodation Arrival Date, the Client informs the Accommodation Provider of all the decisive facts for applying the discount according to the conditions of the Accommodation Provider for its provision, specified in the Accommodation Provider&#8217;s Offer. Upon conclusion of the Accommodation Contract, the Client shall not be entitled to any other and\/or additional discount, unless specified in Article VIII. Paragraph 8.1 of the GTC.<\/p>\n<p>4.4 The prices for Accommodation are set in the legal currency unit of the Czech Republic, the Czech koruna (CZK), and payment is made in the legal currency unit of the Czech Republic, the Czech koruna (CZK) or in EUR. The daily EUR exchange rate set by the CNB valid on the date of the Booking or on the Check-in Date in the case of an Accommodation Contract concluded at the reception of the Resort is used to convert the price of Accommodation into EUR.<\/p>\n<p style=\"text-align: center;\"><strong>Article V.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Changes to the reservation<\/strong><\/p>\n<p>5.1 In the event that circumstances arise which prevent the Accommodation Provider from providing the Client with Accommodation according to the Reservation, and if, due to the situation, it is possible to provide the Client with other accommodation and\/or an alternative service at a date, scope and quality identical or at least close to the originally booked Accommodation, or to provide the same Accommodation at an alternative date, the Accommodation Provider shall be entitled and obliged to make the corresponding changes. In such a case, the Accommodation Provider is obliged to inform the Client without undue delay about the conditions of this change and propose this change to the Client. The Client shall be entitled to withdraw from the Accommodation Contract in case of disagreement with such notified change. The Accommodation Provider is then obliged to return to the Client all payments made in connection with the Accommodation Contract without undue delay after the withdrawal. The provisions of these GTC on cancellation fees do not apply to the benefits returned under this paragraph.<\/p>\n<p>If the Client does not withdraw from the Contract within 5 days of receiving notice of such change, the Client shall be deemed to have accepted such change.<\/p>\n<p>5.2 In the event of inability to provide the Client with the ordered and paid service in the scope and quality corresponding to the agreed terms and conditions, the Accommodation Provider is obliged to return to the Client the consideration paid by the Client for such service. However, in the event that the Accommodation Provider provides the Client, with the Client&#8217;s consent, with a substitute service of the same or higher scope and\/or quality, such substitute performance by the Accommodation Provider shall be deemed to be the provision of the originally agreed service and the Client shall have no further claims against the Accommodation Provider for failure to provide the originally ordered and paid service.<\/p>\n<p>5.3 In the event that the Client is provided with Accommodation of a higher quality or scope than that specified in the Booking, the Client shall be charged the price of the Accommodation as per the Booking.<\/p>\n<p>5.4 The Accommodation Provider shall not be liable for changes caused by force majeure, decisions of public authorities, extraordinary circumstances or events which the Accommodation Provider could not foresee or which could not have been prevented even if all reasonably required efforts were made.<\/p>\n<p style=\"text-align: center;\"><strong>Article VI.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Cancellation or non-use of the reservation and cancellation fee<\/strong><\/p>\n<p>6.1 Cancellation and withdrawal from the Accommodation Contract<\/p>\n<ol>\n<li>The Client has the right to terminate the Accommodation Contract at any time prior to the Check-in Date without notice and without giving any reason and\/or to withdraw due to a material breach of the Accommodation Provider&#8217;s obligations and in the cases set out in the GTC. The Accommodation Provider shall be entitled to withdraw from the Contract in the cases provided for in these GTC and\/or when the Client materially breaches the obligations set out in the Accommodation Contract, these GTC and\/or the laws of the Czech Republic.<\/li>\n<li>The Accommodation Provider is entitled to terminate the Accommodation Contract without notice before the expiry of the agreed period in the event that the Client and\/or persons accompanying him\/her, despite a warning, grossly violate their obligations under the Accommodation Contract, these GTC, the Accommodation Provider&#8217;s accommodation or other operating rules or the laws of the Czech Republic or good morals.<\/li>\n<\/ol>\n<p style=\"text-align: center;\"><strong>Cancellation of Reservation<\/strong><\/p>\n<p>3.The Reservation shall be deemed cancelled by the expiry of the day on which the Client, after sending the Reservation, was obliged to pay the price of the Accommodation in accordance with the payment terms of the GTC at the time of their due date (see Article III, Paragraph 3.1 of the GTC). The Accommodation Contract shall not come into existence in such a case.<\/p>\n<p>4.The reservation shall be deemed cancelled in the case according to paragraph 6.7 of this Article VI.<\/p>\n<p>6.2 The Client is obliged to pay a cancellation fee to the Accommodation Provider in the cases referred to in paragraphs 6.1.2, 6.1.3 and 6.1.4 of this Article VI, except in the cases where the Client, by withdrawing from the Accommodation Contract, exercises his\/her right to withdraw from the Accommodation Contract under certain conditions granted by law or withdraws from the Accommodation Contract due to a material breach of the Accommodation Provider&#8217;s obligations.<\/p>\n<p>6.3 The amount of the Cancellation Fee shall be agreed depending on the Accommodation Booking Option and the time remaining from the date of delivery of the proper notice and\/or withdrawal from the Accommodation Contract to which the Cancellation Fee is linked pursuant to the previous paragraph 6.2. The amount of the cancellation fee is calculated as a percentage of the price of the Accommodation. Upon such termination, withdrawal from the Accommodation Agreement made:<\/p>\n<p>Reservation with cancellation and Rate of 7 nights or more<\/p>\n<p>&#8211; from the 7th (seventh) day to the Check-in Date, 100% of the Accommodation Rate,<\/p>\n<p>&#8211; after the Arrival Date 100% of the Accommodation price<\/p>\n<p>Non-refundable reservation<\/p>\n<p>&#8211; Any time from the date of the Booking to the Check-in Date 100% of the Accommodation price,<\/p>\n<p>&#8211; after the Check-in Date 100% of the Accommodation price.<\/p>\n<p>Group bookings<\/p>\n<p>&#8211; from the 30th (thirtieth) day until the Check-in Date 100% of the Accommodation price<\/p>\n<p>&#8211; after the Arrival Date 100% of the Accommodation price<\/p>\n<p>Group bookings &#8211; Adjustment of the number of accommodation units in the booking and the number of persons on board<\/p>\n<p>&#8211; Adjustment of the number of accommodation units in the reservation and the number of persons on board free of charge until the 4th (fourth) Day until the arrival date<\/p>\n<p>&#8211; from the 3rd (third) to the Check-in Date 100% of the price of Accommodation and meals<\/p>\n<p>6.4 Both notice and withdrawal from the Accommodation Contract must be in writing and must be delivered to the other party. The Accommodation Contract shall be terminated on the date on which written notice or withdrawal is served on the other party.<\/p>\n<p>6.5 In determining the number of days remaining until the Check-in Date for the purposes of calculating the amount of the Cancellation Fee, the date on which the written notice or withdrawal is delivered to the other Party or the cancellation of the Booking is included in that number of days but does not include the Check-in Date.<\/p>\n<p>6.6 In the event that the Client fails to arrive at the Accommodation on the Arrival Date and\/or fails to use the agreed number of days of accommodation and\/or the agreed services through no fault of the Accommodation Provider, the Client shall not be entitled to any financial and\/or other compensation and\/or provision of alternative accommodation or services in relation to the Accommodation Provider and the Accommodation Provider shall be entitled to 100% of the price of the Accommodation.<\/p>\n<p>6.7 In the event of the Client&#8217;s failure to attend for the use of the Accommodation and the Accommodation Provider has no further communication from the Client in respect of the matter, the Booking shall be deemed cancelled on the expiry of 10:00 a.m. (the tenth hour) of the day following the Arrival Date. The Client shall thereby lose the right to the provision of Accommodation according to the Reservation with the consequences pursuant to paragraph 6.6 of these GTC and the Accommodation Provider shall be entitled to provide Accommodation to another person interested in accommodation.<\/p>\n<p>6.8 Upon the effective termination and\/or withdrawal from the Accommodation Contract, the Accommodation Provider shall return to the Client all benefits received from the Client after deduction of the cancellation fee or other benefits under the Accommodation Contract, unless the total amount of benefits paid by the Client in accordance with these GTC has been exhausted, within fourteen (14) days of receipt thereof.<\/p>\n<p>6.9 The cancellation or termination of the Accommodation Contract shall not affect the right of the Accommodation Provider to payment of the price of the Accommodation, or any cancellation fee, the rights of the Parties to compensation for damages arising from the breach of a contractual obligation or arrangements which, by their nature, are intended to bind the Parties after the termination of the Accommodation Contract.<\/p>\n<p style=\"text-align: center;\"><strong>Article VII.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Rights and Obligations of the Client<\/strong><\/p>\n<p>7.1 The basic rights of the Client are primarily:<\/p>\n<p>&#8211; the right to the provision of the ordered and paid for Accommodation in the scope and under the terms of the Accommodation Contract,<\/p>\n<p>&#8211; the right to be provided with information concerning the accommodation and services offered and provided by the Accommodation Provider,<\/p>\n<p>&#8211; the right to terminate the Contract at any time without notice or to withdraw from the Contract due to a material breach of the obligations of the Accommodation Provider and in other cases according to the GTC under the conditions specified in these GTC, the Accommodation Contract or the legal regulations of the Czech Republic.<\/p>\n<p>&#8211; the right to notify the Accommodation Provider in writing that another person will participate in the Accommodation in his\/her place according to the Accommodation Contract, provided that such notification includes a declaration of this person (new Client) that he\/she agrees to the accommodation, services and their price specified in the Accommodation Contract and that he\/she meets all conditions for participation in the Accommodation, if required. The original Client and the new Client shall be jointly and severally liable for payment of the total price stated under the Accommodation Agreement and any administrative or other costs incurred by the Accommodation Provider in connection with the change of Client.<\/p>\n<p>&#8211; The right to claim for faulty or poor quality accommodation or services and to have them dealt with in accordance with these GTC.<\/p>\n<p>&#8211; The right to protection of personal data and other data relating to the Client and fellow travellers.<\/p>\n<p>7.2 The Client&#8217;s basic obligations are in particular:<\/p>\n<p>&#8211; the obligation to fill in the Reservation completely and truthfully, any attached forms necessary for the provision of the Accommodation and to present upon arrival at the Accommodation the necessary documents to identify the Client and fellow travellers (valid ID card, valid passport) and, where applicable, to notify any changes to these data without undue delay.<\/p>\n<p>&#8211; complete and sign the registration card when registering for the Accommodation.<\/p>\n<p>&#8211; to notify the Accommodation Provider of the possible participation of foreign nationals.<\/p>\n<p>&#8211; the obligation to notify the Host of any change in the number of persons using the property and, if the Host agrees to the change, to enter them in the book of guests at the Host&#8217;s reception and to pay the price of Accommodation for the persons not listed in the Reservation in accordance with the Host&#8217;s price list. In the event of exceeding the maximum number of persons allowed for a given property and\/or violation of the obligation to declare persons not listed in the Reservation and using the property, the Accommodation Provider is entitled to withdraw from the Contract for a material breach thereof and to evict the Client, persons accompanying him\/her and other persons from the Accommodation, thereby losing the right to the provision of the Accommodation specified in the Accommodation Contract as well as the right to reimbursement of the paid and unused Accommodation.<\/p>\n<p>&#8211; the obligation to pay the Accommodation Price to the Accommodation Provider with the payment terms set out in the Accommodation Contract and in accordance with these GTC and to prove payment thereof upon the request of the Accommodation Provider.<\/p>\n<p>&#8211; the obligation to pay the Cancellation Fee to the Accommodation Provider in the cases specified in these GTC.<\/p>\n<p>&#8211; the obligation to take over from the Accommodation Provider the documents necessary for the use of the Accommodation.<\/p>\n<p>&#8211; the obligation to arrive at the place of use of the Accommodation at the specified time.<\/p>\n<p>&#8211; the obligation to comply with the instructions of the Accommodation Provider&#8217;s employees, the Accommodation Provider&#8217;s accommodation and other operating rules issued for the use and provision of accommodation and the use of services in the individual Amenity Resorts. In the event that the Client or persons accompanying him\/her, despite a warning, grossly violate the obligations arising from the Accommodation Contract, these GTC or the regulations (rules) of the Accommodation Provider, legal regulations or good manners, or disrupt the program or the use of accommodation and services of other clients of the Accommodation Provider, the Accommodation Provider is entitled to evict the Client and persons accompanying him\/her from the accommodation or the use of services (terminate the Accommodation Contract without notice), whereby the Client loses the right to the provision of the Accommodation agreed in the Accommodation Contract, as well as the right to compensation for the paid and unused Accommodation.<\/p>\n<p>&#8211; The Client and persons accompanying the Client are obliged to behave in such a way that their behaviour does not interfere with or restrict the use of the Accommodation and\/or services of other clients of the Accommodation Provider.<\/p>\n<p>&#8211; The Client&#8217;s obligation to pay for any damage to the Accommodation Provider&#8217;s property caused by him\/her, persons accompanying him\/her or other persons and\/or his\/her pets which he\/she has culpably allowed access to the Accommodation Provider&#8217;s property.<\/p>\n<p>&#8211; the obligation to indicate at the time of Booking that he\/she is enquiring about a property where accommodation is possible with pets and the number of pets, if any. In the event that the Client fails to do so, the Accommodation Provider is advised that only a limited number of properties are available for accommodation of Clients with pets, or in some resorts accommodation with pets is not permitted at all, and that it will not be possible to provide the Client with such a property due to the exhaustion of capacity, shall be entitled to refuse to accommodate the Client and to withdraw from the Accommodation Contract, whereupon the Client shall lose the right to the provision of the Accommodation agreed in the Accommodation Contract, as well as the right to reimbursement of the paid and unused Accommodation unless otherwise agreed by the Parties.<\/p>\n<p>&#8211; the Client&#8217;s obligation to pay the Accommodation Provider the difference in the price of the Accommodation after the discount specified in the Booking if the Client fails to prove to the Accommodation Provider that the conditions for granting the discount on the price of the Accommodation have been met.<\/p>\n<p>&#8211; The Client (whether as a natural person or a legal entity) is responsible for compliance with the obligations arising from the Accommodation Contract, these GTC, the accommodation and operating rules of the Accommodation Provider and the legal regulations of the Czech Republic by the natural persons specified in the Booking Confirmation and\/or accompanying it.<\/p>\n<p>7.3 More detailed regulations of rights and obligations are contained in the accommodation and other operating rules of the individual resorts, which are publicly available to clients in the individual resorts.<\/p>\n<p style=\"text-align: center;\"><strong>Article VIII.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Complaints and information on out-of-court dispute resolution<\/strong><\/p>\n<p>8.1 The Client is entitled to complain to the Accommodation Provider about the quality of the accommodation and\/or services provided if their quality or scope or other conditions do not correspond to the scope, quality and conditions specified in the Accommodation Contract. The Accommodation Provider undertakes to ascertain the circumstances of the complaint without undue delay and, in the event of a justified complaint, to remedy the defective condition or provide the Client with a discount. The Client is obliged to file a complaint with the Accommodation Provider without undue delay after discovering the defective provision. Later claims will not be taken into account.<\/p>\n<p>8.2 Information on out-of-court dispute resolution &#8211; The competent body for out-of-court dispute resolution (ADR) between the Operator and the Client arising from the provision of accommodation and related services (consumer disputes) is, according to Section 20e(d) of Act No. 634\/1992 Coll., on Consumer Protection, as amended, the Czech Trade Inspection, with its registered office at \u0160t\u011bp\u00e1nsk\u00e1 567\/15, 120 00 Prague 2, ID No. 00020869, internet address: http:\/\/www.coi.cz\/ or another body authorised by the Ministry of Industry and Trade.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center;\"><strong>Article IX.<\/strong><\/p>\n<p style=\"text-align: center;\"><strong>Other provisions<\/strong><\/p>\n<p>9.1 Accommodation of the Client by the Accommodation Provider is possible at the earliest from 16:00 on the day specified in the Reservation as the first day of accommodation. The Client is obliged to hand over the vacated property on the last day of accommodation specified in the Accommodation Contract no later than 10:00 a.m. In case of delay in handing over the vacated property by the Client, the Accommodation Provider is entitled to charge the Client a contractual penalty of CZK 500,- (in words: five hundred Czech crowns) for each hour of delay in handing over the vacated property. This is without prejudice to the right of the Accommodation Provider to full compensation for damages.<\/p>\n<p>9.2 If the Accommodation Provider reasonably suspects that the Client is using the facility in violation of the terms of the Accommodation Agreement or in violation of the Accommodation Provider&#8217;s accommodation or operating rules or in violation of public order, the Accommodation Provider is entitled to enter the facility and inspect its use.<\/p>\n<p>9.3 The Accommodation Provider shall not be liable for any damage to the functionality of the Client&#8217;s electrical or electronic equipment or for any mistakes or incorrect information provided by other persons about events or services.<\/p>\n<p>9.4 A Client who checks in before 6:00 a.m. (six o&#8217;clock) shall pay the rate for the entire previous night.<\/p>\n<p>9.5 None of the parking areas of each Amenity Resorts, including the garages, is a secure car park or secure garage, nor does the Supplier provide any supervision of Clients&#8217; parked vehicles and\/or their accessories.<\/p>\n<p>9.6 By ticking the box &#8220;I agree to the sending of commercial communications by electronic means in accordance with Act No. 480\/2004 Coll. and the processing of personal data for these purposes&#8221; in the Accommodation Provider&#8217;s booking form located on the website www.amenity.cz (hereinafter referred to as the &#8220;Booking Form&#8221;) and by submitting it (or if the Accommodation Agreement is not concluded through the Accommodation Provider&#8217;s booking system located on www.amenity.cz then by another express and demonstrable manifestation of the Client&#8217;s will:<\/p>\n<p>(i) confirms that all personal data provided in the Booking Form (or other demonstrable expression of his\/her will containing the required information, if the Accommodation Contract is not concluded through the Accommodation Provider&#8217;s booking system) is true and correct, that he\/she has been informed of his\/her rights related to the management and processing of his\/her personal data, in particular that he\/she has rights under Regulation (EU) No. 2016\/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95\/46\/EC (General Data Protection Regulation) (hereinafter referred to as the &#8220;Regulation&#8221;) &#8211; to withdraw consent at any time, to request from the Accommodation Provider as data controller information on what personal data it processes, request a copy of this data, request access to this data from the Accommodation Provider and have it updated or corrected, or request a restriction of processing, request the deletion of this personal data from the Accommodation Provider, request data portability, file a complaint with the Office for Personal Data Protection or apply to the court. respectively. have read the contents of the Personal Data Processing Policy and the commercial communications available on the website www.amenity.cz and in the Booking Form; and<\/p>\n<p>(ii) has given his\/her consent based on the foregoing instructions:<\/p>\n<p>&#8211; to the processing of his\/her personal data within the meaning of the Regulation by the Accommodation Provider as a controller or other persons with whom the Accommodation Provider enters into a relevant contract as a processor under the Regulation, including the disclosure and transfer of the data provided to such processors and persons cooperating with the Accommodation Provider under a contract within the meaning of the Regulation, as follows<\/p>\n<p>o to the extent of his name, surname, address, telephone number and email address data provided by him in the Booking Form (or other demonstrable expression of his will containing this information, unless the Accommodation Contract is concluded through the Accommodation Provider&#8217;s booking system<\/p>\n<p>o for an indefinite period of time, or until his\/her consent is revoked or refused, or his\/her disagreement is expressed,<\/p>\n<p>o for business and marketing purposes, in particular for offering trade, services, products and information about events and activities of both the Accommodation Provider and third parties &#8211; GOLF EXPLOITATION, s.r.o., ID No.: 25154010, with its registered office in Prague 4 &#8211; Kunratice, Postal Code 14800, Ratajova 1113\/8, e-mail contact info@golf-exploitation.cz and persons forming a concern with the Accommodation Provider within the meaning of the relevant legislation, in particular 3M Developer, a.s, I\u010cO: 27196585, with its registered office in Prague 4 &#8211; Kunratice, Postal Code 14800, Ratajova 1113\/8, e-mail contact: info@3mdeveloper.cz, and offers made by both the Accommodation Provider and these third parties, as well as sending commercial communications by electronic means pursuant to Act No. 480\/2004 Coll. on Certain Information Society Services and on Amendments to Certain Acts, as amended (hereinafter referred to as the &#8220;IS Services Act&#8221;);<\/p>\n<p>&#8211; using the details of the electronic contact provided by the Client in the Reservation Form (or any other demonstrable expression of his\/her will containing this information, unless the Accommodation Contract is concluded through the Accommodation Provider&#8217;s reservation system) for the purpose of disseminating commercial communications within the meaning of the IS Services Act (i.e. sending commercial communications to the Client via electronic means by the Accommodation Provider and the third parties referred to in the preceding paragraph), which will include commercial communications concerning the products, services, products and activities of both the Accommodation Provider and the third parties referred to in the preceding paragraph.<\/p>\n<p>9.8 By ticking the box &#8220;I agree to the General Terms and Conditions&#8221; Zm\u011bna t\u011bchto VOP nab\u00fdv\u00e1 \u00fa\u010dinnosti okam\u017eikem zve\u0159ejn\u011bn\u00ed nebo doru\u010den\u00edm jej\u00edho zn\u011bn\u00ed Klientovi. V p\u0159\u00edpad\u011b nesouhlasu Klienta se zve\u0159ejn\u011bnou zm\u011bnou VOP, je Klient povinen tento nesouhlas Ubytovateli p\u00edsemn\u011b sd\u011blit nejpozd\u011bji do dvou dn\u016f od doru\u010den\u00ed zm\u011bny VOP.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek II.<\/strong>\r\n<strong>Postup p\u0159i rezervaci a uzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed<\/strong><\/p>\r\n<p style=\"text-align: left;\">2.1 Ubytovatel nab\u00edz\u00ed ubytov\u00e1n\u00ed a dal\u0161\u00ed slu\u017eby s t\u00edm souvisej\u00edc\u00ed (d\u00e1le p\u0159\u00edpadn\u011b jen \u201eUbytov\u00e1n\u00ed\u201c) z\u00e1jemc\u016fm prost\u0159ednictv\u00edm sv\u00fdch internetov\u00fdch str\u00e1nek www.amenity.cz a prost\u0159ednictv\u00edm schv\u00e1len\u00fdch zprost\u0159edkovatel\u016f (d\u00e1le jen \u201eNab\u00eddka\u201c). Nab\u00eddka je z\u00e1vazn\u00e1 za podm\u00ednek a po dobu v n\u00ed uveden\u00fdch, p\u0159i\u010dem\u017e Ubytovatel si vyhrazuje pr\u00e1vo jednostrann\u011b m\u011bnit \u010di up\u0159es\u0148ovat konkr\u00e9tn\u00ed podm\u00ednky dan\u00e9 Nab\u00eddky. Pro \u00fa\u010dely uzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed je rozhodn\u00fd stav Nab\u00eddky k okam\u017eiku, kdy Klient provede rezervaci Ubytov\u00e1n\u00ed prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele.<\/p>\r\n<p style=\"text-align: center;\">2.2 Rezervace Ubytov\u00e1n\u00ed<\/p>\r\n<p style=\"text-align: left;\">Rezervace Ubytov\u00e1n\u00ed prob\u00edh\u00e1 prost\u0159ednictv\u00edm elektronick\u00e9ho rezerva\u010dn\u00edho formul\u00e1\u0159e um\u00edst\u011bn\u00e9ho na webov\u00fdch str\u00e1nk\u00e1ch Ubytovatele www.amenity.cz., p\u0159\u00edpadn\u011b jin\u00fdm zp\u016fsobem individu\u00e1ln\u011b dohodnut\u00fdm s Ubytovatelem. Jedn\u00e1 se o tyto varianty: (a) Nevratn\u00e1 rezervace, (b) Sazba s mo\u017enost\u00ed storna, (c) Sazba 7 a v\u00edce noc\u00ed (viz \u010dl\u00e1nek III.VOP).\r\nKlient na webov\u00fdch str\u00e1nk\u00e1ch Ubytovatele www.amenity.cz zad\u00e1 z\u00e1kladn\u00ed po\u017eadavky pro Ubytov\u00e1n\u00ed (term\u00edn p\u0159\u00edjezdu, term\u00edn odjezdu, po\u010det a status osob), d\u00e1le proklikem pol\u00ed\u010dka \u201eRezervovat\u201c vstoup\u00ed do rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele, a n\u00e1sledn\u011b z nab\u00eddky zvol\u00ed variantu rezervace k po\u017eadovan\u00e9mu typu Ubytov\u00e1n\u00ed. V dal\u0161\u00edm kroku vypln\u00ed \u00fadaje v rezerva\u010dn\u00edm formul\u00e1\u0159i \u00fapln\u011b a pravdiv\u011b (v\u010detn\u011b uveden\u00ed I\u010cO a DI\u010c a \u017e\u00e1dosti o vystaven\u00ed da\u0148ov\u00e9ho dokladu, je-li po\u017eadov\u00e1n Klientem, a to do pozn\u00e1mky ve formul\u00e1\u0159i), d\u00e1le potvrd\u00ed za\u0161krtnut\u00edm p\u0159\u00edslu\u0161n\u00e9ho pol\u00ed\u010dka skute\u010dnost, \u017ee se sezn\u00e1mil a souhlas\u00ed s t\u011bmito VOP a Z\u00e1sadami zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f (kter\u00e9 jsou proklikem jejich n\u00e1zvu Klientovi k dispozici) a souhlas\u00ed s nimi. Tot\u00e9\u017e plat\u00ed v p\u0159\u00edpadn\u011b zas\u00edl\u00e1n\u00ed obchodn\u00edch sd\u011blen\u00ed Klientovi prost\u0159ednictv\u00edm elektronick\u00fdch prost\u0159edk\u016f dle z\u00e1kona \u010d. 480\/2004 Sb. a zpracov\u00e1n\u00edm osobn\u00edch \u00fadaj\u016f pro tyto \u00fa\u010dely (d\u00e1le jen \u201eRezervace\u201c). Na existenci VOP a Z\u00e1sad zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f a jejich zn\u011bn\u00ed je Klient dostate\u010dn\u00fdm zp\u016fsobem p\u0159ed vlastn\u00edm uskute\u010dn\u011bn\u00edm Rezervace upozorn\u011bn a m\u00e1 mo\u017enost se s nimi sezn\u00e1mit. Klientovi nebude umo\u017en\u011bno dokon\u010dit Rezervaci bez vysloven\u00ed souhlasu s VOP a Z\u00e1sadami zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f. VOP a Z\u00e1sady zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f tvo\u0159\u00ed ned\u00edlnou sou\u010d\u00e1st smlouvy.\r\nP\u0159ed odesl\u00e1n\u00edm Rezervace m\u00e1 Klient mo\u017enost zkontrolovat si spr\u00e1vnost a \u00faplnost \u00fadaj\u016f v rezerva\u010dn\u00edm formul\u00e1\u0159i. \u00dadaje uveden\u00e9 v odeslan\u00e9 Rezervaci jsou pova\u017eov\u00e1ny za spr\u00e1vn\u00e9 a z\u00e1vazn\u00e9, p\u0159i\u010dem\u017e dal\u0161\u00ed \u010di jin\u00e9 zm\u011bny po odesl\u00e1n\u00ed Rezervace prost\u0159ednictv\u00edm rezerva\u010dn\u00edho formul\u00e1\u0159e nejsou mo\u017en\u00e9. V p\u0159\u00edpad\u011b pot\u0159eby zm\u011bn se Klient obr\u00e1t\u00ed na recepci p\u0159\u00edslu\u0161n\u00e9ho resortu, ve kter\u00e9m je poskytov\u00e1no Ubytov\u00e1n\u00ed. Rezervaci Klient ode\u0161le proklikem pol\u00ed\u010dka \u201ePotvrdit rezervaci\u201c.\r\nOdesl\u00e1n\u00edm Rezervace Ubytovateli Klient potvrzuje, \u017ee se pln\u011b sezn\u00e1mil s t\u011bmito VOP, p\u0159i\u010dem\u017e s nimi souhlas\u00ed a uzn\u00e1v\u00e1 je jako podm\u00ednky a ned\u00edlnou sou\u010d\u00e1st smlouvy o ubytov\u00e1n\u00ed.\r\nOdesl\u00e1n\u00edm Rezervace Klient d\u00e1v\u00e1 z\u00e1vazn\u011b najevo z\u00e1jem uzav\u0159\u00edt Smlouvu o ubytov\u00e1n\u00ed.\r\nPo odesl\u00e1n\u00ed Rezervace je Klient v p\u0159\u00edpad\u011b Platby kartou p\u0159esm\u011brov\u00e1n na platebn\u00ed br\u00e1nu (viz. \u010dl\u00e1nek III. VOP) a jej\u00edm prost\u0159ednictv\u00edm uhrad\u00ed cenu Ubytov\u00e1n\u00ed, p\u0159i\u010dem\u017e p\u0159i placen\u00ed Klient postupuje podle pokyn\u016f na webov\u00e9m rozhran\u00ed. V p\u0159\u00edpad\u011b varianty Platba p\u0159evodem Klient obdr\u017e\u00ed od Ubytovatele neprodlen\u011b po odesl\u00e1n\u00ed Rezervace zpr\u00e1vu na e-mail uveden\u00fd v Rezervaci obsahuj\u00edc\u00ed pokyny k platb\u011b. Po \u00fasp\u011b\u0161n\u00e9m proveden\u00ed platby obdr\u017e\u00ed Klient potvrzen\u00ed o p\u0159ijet\u00ed Rezervace obsahuj\u00edc\u00ed shrnut\u00ed Rezervace a potvrzen\u00ed o proveden\u00e9 platb\u011b.<\/p>\r\n<p style=\"text-align: center;\">2.3 Uzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed<\/p>\r\n<p style=\"text-align: left;\">Smlouva o ubytov\u00e1n\u00ed uzav\u0159en\u00e1 mezi Klientem a Ubytovatelem, jej\u00edm\u017e p\u0159edm\u011btem je poskytnut\u00ed Ubytov\u00e1n\u00ed dle Rezervace a\/nebo dle dohody s Ubytovatelem p\u0159i sjedn\u00e1n\u00ed Ubytov\u00e1n\u00ed v Den n\u00e1stupu na ubytov\u00e1n\u00ed na recepci resortu, ve kter\u00e9m Klient po\u017eaduje Ubytov\u00e1n\u00ed (d\u00e1le jen \u201eUzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed na recepci resortu\u201c) se uzav\u00edr\u00e1 podle pr\u00e1vn\u00edho \u0159\u00e1du \u010cesk\u00e9 republiky, zejm\u00e9na v souladu se z\u00e1konem \u010d. 89\/2012 Sb., ob\u010dansk\u00fd z\u00e1kon\u00edk ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f (d\u00e1le jen \u201eSmlouva o ubytov\u00e1n\u00ed\u201c). Je-li Klient fyzick\u00e1 osoba, kter\u00e1 jedn\u00e1 mimo r\u00e1mec sv\u00e9 podnikatelsk\u00e9 \u010dinnosti nebo mimo r\u00e1mec v\u00fdkonu sv\u00e9ho povol\u00e1n\u00ed, \u0159\u00edd\u00ed se Smlouva o ubytov\u00e1n\u00ed ve v\u011bcech neupraven\u00fdch VOP rovn\u011b\u017e z\u00e1konem \u010d. 634\/1992 Sb., o ochran\u011b spot\u0159ebitele ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f. Smlouva o ubytov\u00e1n\u00ed a VOP jsou vyhotoveny v \u010desk\u00e9m jazyce. Kupn\u00ed smlouvu lze uzav\u0159\u00edt pouze v \u010desk\u00e9m jazyce, leda\u017ee se Klient s Ubytovatelem dohodnou jinak. V takov\u00e9m p\u0159\u00edpad\u011b plat\u00ed, \u017ee v p\u0159\u00edpad\u011b sporu o v\u00fdklad pojm\u016f plat\u00ed v\u00fdklad Smlouvy o ubytov\u00e1n\u00ed v \u010desk\u00e9m jazyce. Uzav\u0159en\u00e1 Smlouva o ubytov\u00e1n\u00ed je archivov\u00e1na v elektronick\u00e9 podob\u011b u Ubytovatele, kter\u00fd k n\u00ed umo\u017en\u00ed Klientovi p\u0159\u00edstup.\r\nKlient souhlas\u00ed s pou\u017eit\u00edm komunika\u010dn\u00edch prost\u0159edk\u016f na d\u00e1lku pro uzav\u00edr\u00e1n\u00ed Smlouvy o ubytov\u00e1n\u00ed. N\u00e1klady vznikl\u00e9 Klientovi p\u0159i pou\u017eit\u00ed komunika\u010dn\u00edch prost\u0159edk\u016f na d\u00e1lku v souvislosti s uzav\u0159en\u00edm Smlouvy o ubytov\u00e1n\u00ed se neli\u0161\u00ed od z\u00e1kladn\u00ed sazby poskytovatele komunika\u010dn\u00edch prost\u0159edk\u016f na d\u00e1lku a nese je v\u00fdlu\u010dn\u011b Klient. N\u00e1klady spojen\u00e9 s proveden\u00edm platby ceny Ubytov\u00e1n\u00ed nese Prod\u00e1vaj\u00edc\u00ed, s p\u0159\u00edpadnou v\u00fdjimkou Klientem zvolen\u00e9 nadstandardn\u00ed platby.\r\nKlient je povinen uhradit Ubytovateli cenu Ubytov\u00e1n\u00ed stanovenou v Rezervaci zp\u016fsobem a za podm\u00ednek dle platebn\u00edch podm\u00ednek uveden\u00fdch v t\u011bchto VOP (viz tento bod 2.3.1 a \u010dl\u00e1nek VI.VOP). Uzav\u0159en\u00edm smlouvy o ubytov\u00e1n\u00ed mezi Klientem a Ubytovatelem se Ubytovatel zavazuje Klientovi poskytnout Ubytov\u00e1n\u00ed v rozsahu a za podm\u00ednek uveden\u00fdch v Rezervaci a t\u011bchto VOP.\r\nOkam\u017eikem uhrazen\u00ed celkov\u00e9 ceny Ubytov\u00e1n\u00ed dle Rezervace je mezi Klientem a Ubytovatelem uzav\u0159ena Smlouva o ubytov\u00e1n\u00ed, jej\u00ed\u017e sou\u010d\u00e1st\u00ed jsou tyto VOP, a to na ubytov\u00e1n\u00ed a slu\u017eby uveden\u00e9 v Klientem odeslan\u00e9 Rezervaci \u010di sjednan\u00e9 p\u0159i Uzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed na recepci resortu.\r\n2.4 Vyskytnou-li se v Nab\u00eddce, Rezervaci a\/nebo Potvrzen\u00ed rezervace chyby v psan\u00ed \u010di po\u010d\u00edt\u00e1n\u00ed (zejm\u00e9na zjevn\u011b nep\u0159im\u011b\u0159en\u00e1 cena ubytov\u00e1n\u00ed a\/nebo slu\u017eeb) nebo jin\u00e9 chybn\u00e9 \u00fadaje \u010di jin\u00e9 nesrovnalosti, Ubytovatel si vyhrazuje pr\u00e1vo opravy t\u011bchto chyb nebo n\u00e1pravu jin\u00fdch nesrovnalost\u00ed, jen\u017e provede s\u00e1m nebo na z\u00e1klad\u011b p\u00edsemn\u00e9ho po\u017eadavku Klienta.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek III.<\/strong>\r\n<strong>Platebn\u00ed podm\u00ednky<\/strong><\/p>\r\n<p style=\"text-align: left;\">3.1 Platebn\u00ed podm\u00ednky a lh\u016fta splatnosti ceny Ubytov\u00e1n\u00ed se li\u0161\u00ed v z\u00e1vislosti na v\u00fdb\u011bru varianty rezervace Ubytov\u00e1n\u00ed, kter\u00e9 se odli\u0161uj\u00ed podle doby ode dne proveden\u00ed rezervace Ubytov\u00e1n\u00ed do sjednan\u00e9ho dne zah\u00e1jen\u00ed \u010derp\u00e1n\u00ed Ubytov\u00e1n\u00ed Klientem (d\u00e1le jen \u201eDen n\u00e1stupu na ubytov\u00e1n\u00ed \u201c), zp\u016fsobu zaplacen\u00ed a v\u00fd\u0161e ceny za Ubytov\u00e1n\u00ed, platebn\u00edch a storno podm\u00ednek\r\nNevratn\u00e1 rezervace \u2013 Klient provede Rezervaci kdykoliv p\u0159ed Dnem n\u00e1stupu na ubytov\u00e1n\u00ed, cena Ubytov\u00e1n\u00ed je uhrazena Klientem jednor\u00e1zov\u011b ve v\u00fd\u0161i 100 % ceny za Ubytov\u00e1n\u00ed, p\u0159i\u010dem\u017e pro splatnost a \u00fahradu ceny za Ubytov\u00e1n\u00ed plat\u00ed, \u017ee platba se prov\u00e1d\u00ed bezhotovostn\u011b:\r\na) on-line Platebn\u00ed kartou prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele postupem dle odst.2.2 \u010dl\u00e1nku II. VOP se splatnost\u00ed v den proveden\u00ed Rezervace, anebo\r\nb) v p\u0159\u00edpad\u011b Platba p\u0159evodem mus\u00ed b\u00fdt rezervace provedena 4 a v\u00edce dn\u00ed p\u0159ed Dnem n\u00e1stupu na ubytov\u00e1n\u00ed a Klient obdr\u017e\u00ed od Ubytovatele neprodlen\u011b po odesl\u00e1n\u00ed Rezervace zpr\u00e1vu na e-mail uveden\u00fd v Rezervaci obsahuj\u00edc\u00ed pokyny k platb\u011b. Platba bude Klientem uhrazena jednor\u00e1zov\u011b ve v\u00fd\u0161i 100 % ceny ubytov\u00e1n\u00ed se splatnost\u00ed do t\u0159\u00ed (3) dn\u016f od doru\u010den\u00ed pokyn\u016f Ubytovatele k jej\u00ed platb\u011b, p\u0159i\u010dem\u017e platba prob\u00edh\u00e1 bankovn\u00edm p\u0159evodem na \u00fa\u010det Ubytovatele specifikovan\u00fd v pokynech k platb\u011b. Po \u00fasp\u011b\u0161n\u00e9m proveden\u00ed platby obdr\u017e\u00ed Klient potvrzen\u00ed o p\u0159ijet\u00ed Rezervace obsahuj\u00edc\u00ed shrnut\u00ed Rezervace a potvrzen\u00ed o proveden\u00e9 platb\u011b.\r\nSazba s mo\u017enost\u00ed storna- Klient provede Rezervaci kdykoliv p\u0159ed Dnem n\u00e1stupu na ubytov\u00e1n\u00ed, cena Ubytov\u00e1n\u00ed je uhrazena Klientem jednor\u00e1zov\u011b ve v\u00fd\u0161i 100 % ceny za Ubytov\u00e1n\u00ed, p\u0159i\u010dem\u017e pro splatnost a \u00fahradu ceny za Ubytov\u00e1n\u00ed plat\u00ed, \u017ee platba se prov\u00e1d\u00ed bezhotovostn\u011b:\r\na) on-line Platebn\u00ed kartou prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele postupem dle odst.2.2 \u010dl\u00e1nku II. VOP se splatnost\u00ed v den proveden\u00ed Rezervace, anebo\r\nb) v p\u0159\u00edpad\u011b Platba p\u0159evodem mus\u00ed b\u00fdt rezervace provedena 4 a v\u00edce dn\u00ed p\u0159ed Dnem n\u00e1stupu na ubytov\u00e1n\u00ed a Klient obdr\u017e\u00ed od Ubytovatele neprodlen\u011b po odesl\u00e1n\u00ed Rezervace zpr\u00e1vu na e-mail uveden\u00fd v Rezervaci obsahuj\u00edc\u00ed pokyny k platb\u011b. Platba bude Klientem uhrazena jednor\u00e1zov\u011b ve v\u00fd\u0161i 100 % ceny ubytov\u00e1n\u00ed se splatnost\u00ed do t\u0159\u00ed (3) dn\u016f od doru\u010den\u00ed pokyn\u016f Ubytovatele k jej\u00ed platb\u011b, p\u0159i\u010dem\u017e platba prob\u00edh\u00e1 bankovn\u00edm p\u0159evodem na \u00fa\u010det Ubytovatele specifikovan\u00fd v pokynech k platb\u011b. Po \u00fasp\u011b\u0161n\u00e9m proveden\u00ed platby obdr\u017e\u00ed Klient potvrzen\u00ed o p\u0159ijet\u00ed Rezervace obsahuj\u00edc\u00ed shrnut\u00ed Rezervace a potvrzen\u00ed o proveden\u00e9 platb\u011b.\r\nSazba 7 a v\u00edce noc\u00ed Nevratn\u00e1 rezervace nebo S mo\u017enost\u00ed storna - Klient provede Rezervaci kdykoliv p\u0159ed Dnem n\u00e1stupu na ubytov\u00e1n\u00ed, cena Ubytov\u00e1n\u00ed je uhrazena Klientem jednor\u00e1zov\u011b ve v\u00fd\u0161i 100 % ceny za Ubytov\u00e1n\u00ed, p\u0159i\u010dem\u017e pro splatnost a \u00fahradu ceny za Ubytov\u00e1n\u00ed plat\u00ed, \u017ee platba se prov\u00e1d\u00ed bezhotovostn\u011b:\r\na) on-line Platebn\u00ed kartou prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele postupem dle odst.2.2 \u010dl\u00e1nku II. VOP se splatnost\u00ed v den proveden\u00ed Rezervace, anebo\r\nb) v p\u0159\u00edpad\u011b Platba p\u0159evodem mus\u00ed b\u00fdt rezervace provedena 4 a v\u00edce dn\u00ed p\u0159ed Dnem n\u00e1stupu na ubytov\u00e1n\u00ed a Klient obdr\u017e\u00ed od Ubytovatele neprodlen\u011b po odesl\u00e1n\u00ed Rezervace zpr\u00e1vu na e-mail uveden\u00fd v Rezervaci obsahuj\u00edc\u00ed pokyny k platb\u011b. Platba bude Klientem uhrazena jednor\u00e1zov\u011b ve v\u00fd\u0161i 100 % ceny ubytov\u00e1n\u00ed se splatnost\u00ed do t\u0159\u00ed (3) dn\u016f od doru\u010den\u00ed pokyn\u016f Ubytovatele k jej\u00ed platb\u011b, p\u0159i\u010dem\u017e platba prob\u00edh\u00e1 bankovn\u00edm p\u0159evodem na \u00fa\u010det Ubytovatele specifikovan\u00fd v pokynech k platb\u011b. Po \u00fasp\u011b\u0161n\u00e9m proveden\u00ed platby obdr\u017e\u00ed Klient potvrzen\u00ed o p\u0159ijet\u00ed Rezervace obsahuj\u00edc\u00ed shrnut\u00ed Rezervace a potvrzen\u00ed o proveden\u00e9 platb\u011b.\r\nSkupinov\u00e9 rezervace \u2013 Klient (Firma) potvrd\u00ed Rezervaci na z\u00e1klad\u011b Nab\u00eddky, kterou dostal z obchodn\u00edho odd\u011blen\u00ed Ubytovatele do term\u00ednu, kter\u00fd je sou\u010d\u00e1st\u00ed Nab\u00eddky a to emailem na events@amenity.cz. Cena Ubytov\u00e1n\u00ed je uhrazena Klientem Z\u00e1lohovou fakturou ve v\u00fd\u0161i 100 % ceny za Ubytov\u00e1n\u00ed se splatnost\u00ed 14 dn\u00ed, pokud nebylo s obchodn\u00edm odd\u011blen\u00edm Ubytovatele dohodnuto jinak. Po prob\u011bhl\u00e9 akci se Klientovi do\u00fa\u010dtuje zbytek poskytnut\u00fdch slu\u017eeb na z\u00e1klad\u011b ob\u011bma stranami p\u0159edem odsouhlasen\u00e9ho rozsahu a vystav\u00ed se Kone\u010dn\u00e1 faktura se splatnost\u00ed 14 dn\u00ed, pokud nebylo s obchodn\u00edm odd\u011blen\u00edm Ubytovatele dohodnuto jinak.\r\n3.3 Uhrazen\u00edm ceny Ubytov\u00e1n\u00ed se rozum\u00ed p\u0159ips\u00e1n\u00ed p\u0159\u00edslu\u0161n\u00e9 \u010d\u00e1stky v dob\u011b jej\u00ed splatnosti na bankovn\u00ed \u00fa\u010det Ubytovatele.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek IV.<\/strong>\r\n<strong>Cena<\/strong><\/p>\r\n<p style=\"text-align: left;\">4.1 Cenou Ubytov\u00e1n\u00ed se rozum\u00ed cena uveden\u00e1 v Rezervaci a\/nebo v Nab\u00eddce aktu\u00e1ln\u00ed v Den n\u00e1stupu na ubytov\u00e1n\u00ed, jde-li o Uzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed na recepci resortu, jako cena za sjednan\u00e9 ubytov\u00e1n\u00ed a slu\u017eby (tj. cena ubytov\u00e1n\u00ed v p\u0159\u00edslu\u0161n\u00e9m objektu pro sjednan\u00fd po\u010det osob, strava, dopl\u0148kov\u00e9 slu\u017eby, wellness slu\u017eby, pobyt dom\u00e1c\u00edho mazl\u00ed\u010dka apod.), a to v\u010detn\u011b dan\u00ed a p\u0159\u00edpadn\u00fdch slev. Rekrea\u010dn\u00ed poplatky nejsou v cen\u011b Ubytov\u00e1n\u00ed zahrnuty a jejich platba prob\u011bhne v den p\u0159\u00edjezdu na recepci resortu. Rekrea\u010dn\u00ed poplatky je povinna hradit ka\u017ed\u00e1 dosp\u011bl\u00e1 osoba od 18 let a jejich v\u00fd\u0161e se z\u00e1visl\u00e1 na m\u00edst\u011b pobytu a po\u010dtu rezervovan\u00fdch noc\u00ed, p\u0159i\u010dem\u017e jejich v\u00fd\u0161e se m\u016f\u017ee m\u011bnit dle rozhodnut\u00ed org\u00e1n\u016f \u00fazemn\u00ed samospr\u00e1vy.\r\n4.2 Ubytovatel nen\u00ed opr\u00e1vn\u011bn po dobu platnosti Rezervace jednostrann\u011b nav\u00fd\u0161it cenu Ubytov\u00e1n\u00ed s v\u00fdjimkou p\u0159\u00edpad\u016f:\r\n\u2022 dojde-li ke zm\u011bn\u011b v Rezervaci (nap\u0159. zm\u011bn\u011b objektu \u010di term\u00ednu, po\u010dtu osob, pod.),\r\n\u2022 neprok\u00e1\u017ee-li nebo nedolo\u017e\u00ed-li Klient spln\u011bn\u00ed podm\u00ednek pro poskytnut\u00ed n\u00e1rokovan\u00e9 slevy,\r\n\u2022 dojde-li ke zm\u011bn\u011b pr\u00e1vn\u00ed \u00fapravy \u010di sazeb dan\u011b z p\u0159idan\u00e9 hodnoty.\r\n4.3 Klient m\u00e1 n\u00e1rok na poskytnut\u00ed slevy z ceny Ubytov\u00e1n\u00ed, pokud nejpozd\u011bji p\u0159i odesl\u00e1n\u00ed Rezervace, anebo p\u0159i Uzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed na recepci resortu v Den n\u00e1stupu na ubytov\u00e1n\u00ed, sd\u011bl\u00ed Ubytovateli ve\u0161ker\u00e9 rozhodn\u00e9 skute\u010dnosti pro uplatn\u011bn\u00ed slevy dle podm\u00ednek Ubytovatele pro jej\u00ed poskytnut\u00ed, uveden\u00fdch v Nab\u00eddce Ubytovatele. Po uzav\u0159en\u00ed Smlouvy o ubytov\u00e1n\u00ed, nem\u00e1 Klient n\u00e1rok na poskytnut\u00ed jak\u00e9koli jin\u00e9 a\/nebo dal\u0161\u00ed slevy, nen\u00ed-li v \u010dl\u00e1nku VIII. Odst.8.1 VOP uvedeno jinak.\r\n4.4 Ceny Ubytov\u00e1n\u00ed jsou stanoveny v z\u00e1konn\u00e9 m\u011bnov\u00e9 jednotce \u010cesk\u00e9 republiky korun\u011b \u010desk\u00e9 (K\u010d, CZK) a jejich \u00fahrada prob\u00edh\u00e1 v z\u00e1konn\u00e9 m\u011bnov\u00e9 jednotce \u010cesk\u00e9 republiky korun\u011b \u010desk\u00e9 (K\u010d, CZK) nebo v m\u011bn\u011b EUR. Pro p\u0159epo\u010det ceny Ubytov\u00e1n\u00ed na EUR se pou\u017e\u00edv\u00e1 denn\u00ed kurs m\u011bny EUR stanoven\u00fd \u010cNB platn\u00fd ke dni proveden\u00ed Rezervace, anebo ke Dni n\u00e1stupu na ubytov\u00e1n\u00ed v p\u0159\u00edpad\u011b Uzav\u0159en\u00ed smlouvy o ubytov\u00e1n\u00ed na recepci resortu.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek V.<\/strong>\r\n<strong>Zm\u011bny v rezervaci<\/strong><\/p>\r\n<p style=\"text-align: left;\">5.1 V p\u0159\u00edpad\u011b vzniku okolnost\u00ed, kter\u00e9 br\u00e1n\u00ed Ubytovateli poskytnout Klientovi Ubytov\u00e1n\u00ed dle Rezervace, a je-li mo\u017en\u00e9 vzhledem k vznikl\u00e9 situaci poskytnout Klientovi jin\u00e9 ubytov\u00e1n\u00ed a\/nebo n\u00e1hradn\u00ed slu\u017ebu v term\u00ednu, rozsahu a kvalit\u011b shodn\u00fdch nebo se alespo\u0148 bl\u00ed\u017e\u00edc\u00edch p\u016fvodn\u011b objednan\u00e9mu Ubytov\u00e1n\u00ed, anebo poskytnout stejn\u00e9 Ubytov\u00e1n\u00ed v n\u00e1hradn\u00edm term\u00ednu, je Ubytovatel opr\u00e1vn\u011bn a povinen prov\u00e9st odpov\u00eddaj\u00edc\u00ed zm\u011bny. Ubytovatel je v takov\u00e9m p\u0159\u00edpad\u011b povinen bez zbyte\u010dn\u00e9ho odkladu informovat Klienta o podm\u00ednk\u00e1ch t\u00e9to zm\u011bny a navrhnout tuto zm\u011bnu Klientovi. Klient je opr\u00e1vn\u011bn v p\u0159\u00edpad\u011b nesouhlasu s takto ozn\u00e1menou zm\u011bnou od Smlouvy o ubytov\u00e1n\u00ed odstoupit. Ubytovatel je pak povinen bez zbyte\u010dn\u00e9ho odkladu po odstoupen\u00ed od smlouvy vr\u00e1tit Klientovi ve\u0161ker\u00e1 pln\u011bn\u00ed uhrazen\u00e1 v souvislosti se Smlouvou o ubytov\u00e1n\u00ed. Na pln\u011bn\u00ed vr\u00e1cen\u00e1 dle tohoto odstavce se nevztahuj\u00ed ustanoven\u00ed t\u011bchto VOP o storno-poplatku.\r\nPokud Klient neodstoup\u00ed od smlouvy ve lh\u016ft\u011b do 5 dn\u016f od doru\u010den\u00ed ozn\u00e1men\u00ed o takov\u00e9to zm\u011bn\u011b, plat\u00ed, \u017ee s takovouto zm\u011bnou souhlas\u00ed.\r\n5.2 V p\u0159\u00edpad\u011b nemo\u017enosti poskytnout Klientovi objednanou a zaplacenou slu\u017ebu v rozsahu a kvalit\u011b odpov\u00eddaj\u00edc\u00ed dohodnut\u00fdm podm\u00ednk\u00e1m, je Ubytovatel povinen vr\u00e1tit Klientovi pln\u011bn\u00ed uhrazen\u00e9 Klientem na takovouto slu\u017ebu. V p\u0159\u00edpad\u011b, \u017ee v\u0161ak Ubytovatel poskytne Klientovi s jeho souhlasem n\u00e1hradn\u00ed slu\u017ebu stejn\u00e9ho nebo vy\u0161\u0161\u00edho rozsahu a\/nebo kvality, pova\u017euje se takov\u00e9 n\u00e1hradn\u00ed pln\u011bn\u00ed Ubytovatele za poskytnut\u00ed p\u016fvodn\u011b dohodnut\u00e9 slu\u017eby, a Klient tak nem\u00e1 jak\u00e9koli dal\u0161\u00ed n\u00e1roky v\u016f\u010di Ubytovateli z titulu neposkytnut\u00ed p\u016fvodn\u011b objednan\u00e9 a uhrazen\u00e9 slu\u017eby.\r\n5.3 V p\u0159\u00edpad\u011b, \u017ee Klientovi bude poskytnuto Ubytov\u00e1n\u00ed ve vy\u0161\u0161\u00ed kvalit\u011b \u010di rozsahu, ne\u017e bylo uvedeno v Rezervaci bude Klientovi \u00fa\u010dtov\u00e1na cena Ubytov\u00e1n\u00ed dle Rezervace.\r\n5.4 Ubytovatel neodpov\u00edd\u00e1 za zm\u011bny vyvolan\u00e9 z d\u016fvodu z\u00e1sahu vy\u0161\u0161\u00ed moci, z d\u016fvod\u016f rozhodnut\u00ed org\u00e1n\u016f ve\u0159ejn\u00e9 moci, vzniku mimo\u0159\u00e1dn\u00fdch okolnost\u00ed nebo ud\u00e1lost\u00ed, kter\u00e9 nemohl Ubytovatel p\u0159edv\u00eddat nebo kter\u00fdm nemohlo b\u00fdt zabr\u00e1n\u011bno ani p\u0159i vynalo\u017een\u00ed ve\u0161ker\u00e9ho rozumn\u011b po\u017eadovateln\u00e9ho \u00fasil\u00ed.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek VI.<\/strong>\r\n<strong>Zru\u0161en\u00ed nebo nevyu\u017eit\u00ed rezervace a storno-poplatek<\/strong><\/p>\r\n<p style=\"text-align: left;\">6.1. V\u00fdpov\u011b\u010f a odstoupen\u00ed od Smlouvy o ubytov\u00e1n\u00ed\r\n1. Klient m\u00e1 pr\u00e1vo kdykoli p\u0159ed Dnem n\u00e1stupu na ubytov\u00e1n\u00ed Smlouvu o ubytov\u00e1n\u00ed vypov\u011bd\u011bt bez v\u00fdpov\u011bdn\u00ed doby a uveden\u00ed d\u016fvodu a\/nebo odstoupit z d\u016fvodu podstatn\u00e9ho poru\u0161en\u00ed povinnost\u00ed Ubytovatele a v p\u0159\u00edpadech stanoven\u00fdch VOP. Ubytovatel je opr\u00e1vn\u011bn odstoupit od smlouvy v p\u0159\u00edpadech stanoven\u00fdch t\u011bmito VOP a\/nebo kdy Klient podstatn\u011b poru\u0161\u00ed povinnosti stanoven\u00e9 Smlouvou o ubytov\u00e1n\u00ed, t\u011bmito VOP a\/nebo pr\u00e1vn\u00edmi p\u0159edpisy \u010cesk\u00e9 republiky.\r\n2. Ubytovatel je opr\u00e1vn\u011bn vypov\u011bd\u011bt bez v\u00fdpov\u011bdn\u00ed doby Smlouvu o ubytov\u00e1n\u00ed p\u0159ed uplynut\u00edm sjednan\u00e9 doby v p\u0159\u00edpad\u011b, \u017ee Klient a\/nebo osoby jej prov\u00e1zej\u00edc\u00ed i p\u0159es v\u00fdstrahu hrub\u011b poru\u0161uj\u00ed sv\u00e9 povinnosti vypl\u00fdvaj\u00edc\u00ed ze Smlouvy o ubytov\u00e1n\u00ed, t\u011bchto VOP, ubytovac\u00edch \u010di jin\u00fdch provozn\u00edch \u0159\u00e1d\u016f ubytovatele nebo pr\u00e1vn\u00edch p\u0159edpis\u016f \u010cesk\u00e9 republiky \u010di dobr\u00e9 mravy.\r\nZru\u0161en\u00ed Rezervace\r\n3.Rezervace se pova\u017euje za zru\u0161enou marn\u00fdm uplynut\u00edm dne, ve kter\u00e9m byl Klient po odesl\u00e1n\u00ed Rezervace povinen zaplatit cenu Ubytov\u00e1n\u00ed v souladu s platebn\u00edmi podm\u00ednkami dle VOP v dob\u011b jejich splatnosti (viz. \u010dl\u00e1nek III. odst.3.1 VOP). Smlouva o ubytov\u00e1n\u00ed v takov\u00e9m p\u0159\u00edpad\u011b nevznikne.\r\n4.Rezervace se pova\u017euje za zru\u0161enou v p\u0159\u00edpad\u011b dle odst.6.7 tohoto \u010dl\u00e1nku VI.\r\n6.2 Klient je povinen zaplatit Ubytovateli storno poplatek v p\u0159\u00edpadech uveden\u00fdch v odst.6.1.2., 6.1.3. a 6.1.4. tohoto \u010dl\u00e1nku VI. s v\u00fdjimkou p\u0159\u00edpad\u016f, kdy Klient odstoupen\u00edm od Smlouvy o ubytov\u00e1n\u00ed vyu\u017e\u00edv\u00e1 sv\u00e9ho pr\u00e1va na odstoupen\u00ed od Smlouvy o ubytov\u00e1n\u00ed, kter\u00e9 mu za ur\u010dit\u00fdch podm\u00ednek p\u0159izn\u00e1v\u00e1 z\u00e1kon nebo od Smlouvy o ubytov\u00e1n\u00ed odstoup\u00ed z d\u016fvod\u016f podstatn\u00e9ho poru\u0161en\u00ed povinnost\u00ed Ubytovatele.\r\n6.3 V\u00fd\u0161e storno-poplatku je sjedn\u00e1na v z\u00e1vislosti na variant\u011b rezervace Ubytov\u00e1n\u00ed a dob\u011b, kter\u00e1 zb\u00fdv\u00e1 ode dne doru\u010den\u00ed \u0159\u00e1dn\u00e9 v\u00fdpov\u011bdi a\/nebo odstoupen\u00ed od Smlouvy o ubytov\u00e1n\u00ed, se kter\u00fdmi je podle p\u0159edchoz\u00edho odst. 6.2 spojen storno-poplatek. V\u00fd\u0161e storno-poplatku se po\u010d\u00edt\u00e1 v procentu\u00e1ln\u00ed v\u00fd\u0161i z ceny Ubytov\u00e1n\u00ed. P\u0159i takov\u00e9 v\u00fdpov\u011bdi, odstoupen\u00ed od Smlouvy o ubytov\u00e1n\u00ed proveden\u00fdch:\r\nSazba s mo\u017enost\u00ed storna a Sazba 7 a v\u00edce noc\u00ed\r\n\u2022 od 7. (sedm\u00e9ho) dne do Dne n\u00e1stupu na ubytov\u00e1n\u00ed 100 % ceny Ubytov\u00e1n\u00ed,\r\n\u2022 po Dni n\u00e1stupu na ubytov\u00e1n\u00ed 100 % ceny Ubytov\u00e1n\u00ed\r\nNevratn\u00e1 rezervace\r\n\u2022 kdykoliv od dne proveden\u00ed Rezervace do Dne n\u00e1stupu na ubytov\u00e1n\u00ed 100 % ceny Ubytov\u00e1n\u00ed,\r\n\u2022 po Dni n\u00e1stupu na ubytov\u00e1n\u00ed 100 % ceny Ubytov\u00e1n\u00ed.\r\nSkupinov\u00e9 rezervace\r\n\u2022 od 30. (t\u0159ic\u00e1t\u00e9ho) dne do Dne n\u00e1stupu na ubytov\u00e1n\u00ed 100% ceny Ubytov\u00e1n\u00ed\r\n\u2022 po dni n\u00e1stupu na ubytov\u00e1n\u00ed 100% ceny Ubytov\u00e1n\u00ed\r\nSkupinov\u00e9 rezervace - \u00daprava po\u010dtu ubytovac\u00edch jednotek v rezervaci a po\u010dtu osob na stravov\u00e1n\u00ed\r\n\u2022 \u00faprava po\u010dtu ubytovac\u00edch jednotek v rezervaci a po\u010dtu osob na stravov\u00e1n\u00ed zdarma do 4. (\u010dtvrt\u00e9ho) Dne do n\u00e1stupu na ubytov\u00e1n\u00ed\r\n\u2022 od 3. (t\u0159et\u00edho) do Dne n\u00e1stupu na ubytov\u00e1n\u00ed 100% ceny Ubytov\u00e1n\u00ed a stravy\r\n6.4 V\u00fdpov\u011b\u010f i odstoupen\u00ed od Smlouvy o ubytov\u00e1n\u00ed mus\u00ed b\u00fdt p\u00edsemn\u00e9 a mus\u00ed b\u00fdt doru\u010deny druh\u00e9 smluvn\u00ed stran\u011b. Smlouva o ubytov\u00e1n\u00ed je zru\u0161ena dnem, kdy p\u00edsemn\u00e1 v\u00fdpov\u011b\u010f nebo odstoupen\u00ed byly druh\u00e9 smluvn\u00ed stran\u011b doru\u010deny.\r\n6.5 P\u0159i ur\u010den\u00ed po\u010dtu dn\u00ed zb\u00fdvaj\u00edc\u00edch do Dne n\u00e1stupu na ubytov\u00e1n\u00ed pro \u00fa\u010dely v\u00fdpo\u010dtu v\u00fd\u0161e storno-poplatku se do tohoto po\u010dtu dn\u00ed zapo\u010d\u00edt\u00e1v\u00e1 i den, kdy do\u0161lo k doru\u010den\u00ed p\u00edsemn\u00e9 v\u00fdpov\u011bdi nebo odstoupen\u00ed druh\u00e9 smluvn\u00ed stran\u011b nebo ke zru\u0161en\u00ed Rezervace, nezapo\u010d\u00edt\u00e1v\u00e1 se v\u0161ak do n\u011bj Den n\u00e1stupu na ubytov\u00e1n\u00ed.\r\n6.6 V p\u0159\u00edpad\u011b, \u017ee se Klient v Den n\u00e1stupu na ubytov\u00e1n\u00ed nedostav\u00ed k ubytov\u00e1n\u00ed a\/nebo nevy\u010derp\u00e1 sjednan\u00fd po\u010det dn\u016f ubytov\u00e1n\u00ed a\/nebo sjednan\u00e9 slu\u017eby bez zavin\u011bn\u00ed Ubytovatele, nem\u00e1 Klient n\u00e1rok na jakoukoli finan\u010dn\u00ed a\/nebo jinou n\u00e1hradu a\/nebo poskytnut\u00ed n\u00e1hradn\u00edho ubytov\u00e1n\u00ed ani slu\u017eby ve vztahu k Ubytovateli a Ubytovateli vznik\u00e1 n\u00e1rok na uhrazen\u00ed 100 % ceny Ubytov\u00e1n\u00ed.\r\n6.7 V p\u0159\u00edpad\u011b, \u017ee se Klient nedostav\u00ed k \u010derp\u00e1n\u00ed Ubytov\u00e1n\u00ed a Ubytovatel nebude m\u00edt od Klienta ve v\u011bci jinou zpr\u00e1vu, pova\u017euje se Rezervace za zru\u0161enou marn\u00fdm uplynut\u00edm 10:00 hod. (des\u00e1t\u00e9 hodiny) dne n\u00e1sleduj\u00edc\u00edho po Dni n\u00e1stupu na ubytov\u00e1n\u00ed. Klient t\u00edm ztr\u00e1c\u00ed n\u00e1rok na poskytnut\u00ed Ubytov\u00e1n\u00ed dle Rezervace s n\u00e1sledky dle odst. 6.6 t\u011bchto VOP a Ubytovatel je opr\u00e1vn\u011bn poskytnout Ubytov\u00e1n\u00ed jin\u00e9mu z\u00e1jemci o ubytov\u00e1n\u00ed.\r\n6.8 Po \u00fa\u010dinn\u00e9 v\u00fdpov\u011bdi a\/nebo odstoupen\u00ed od Smlouvy o ubytov\u00e1n\u00ed je Ubytovatel povinen Klientovi vr\u00e1tit ve\u0161ker\u00e1 pln\u011bn\u00ed, kter\u00e1 od n\u011bho p\u0159ijal po zapo\u010dten\u00ed storno-poplatku nebo jin\u00fdch pln\u011bn\u00ed podle Smlouvy o ubytov\u00e1n\u00ed, nebyla-li celkov\u00e1 v\u00fd\u0161e pln\u011bn\u00ed uhrazen\u00e1 Klientem v souladu s t\u011bmito VOP vy\u010derp\u00e1na, a to do \u010dtrn\u00e1cti (14) dn\u016f od jejich doru\u010den\u00ed.\r\n6.9 Odstoupen\u00edm \u010di v\u00fdpov\u011bd\u00ed Smlouvy o ubytov\u00e1n\u00ed nen\u00ed dot\u010deno pr\u00e1vo Ubytovatele na zaplacen\u00ed ceny Ubytov\u00e1n\u00ed, eventu\u00e1ln\u011b storno-poplatku, pr\u00e1va smluvn\u00edch stran na n\u00e1hradu \u0161kody vznikl\u00e9 z poru\u0161en\u00ed smluvn\u00ed povinnosti ani ujedn\u00e1n\u00ed, kter\u00e1 vzhledem ke sv\u00e9 povaze maj\u00ed zavazovat strany i po z\u00e1niku Smlouvy o ubytov\u00e1n\u00ed.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek VII.<\/strong>\r\n<strong>Pr\u00e1va a povinnosti klienta<\/strong><\/p>\r\n<p style=\"text-align: left;\">7.1 Z\u00e1kladn\u00edmi pr\u00e1vy Klienta jsou p\u0159edev\u0161\u00edm:\r\n\u2022 pr\u00e1vo na poskytnut\u00ed objednan\u00e9ho a zaplacen\u00e9ho Ubytov\u00e1n\u00ed v rozsahu a za podm\u00ednek dle Smlouvy o ubytov\u00e1n\u00ed,\r\n\u2022 pr\u00e1vo na poskytnut\u00ed informac\u00ed t\u00fdkaj\u00edc\u00edch se ubytov\u00e1n\u00ed a slu\u017eeb nab\u00edzen\u00fdch a poskytovan\u00fdch Ubytovatelem,\r\n\u2022 pr\u00e1vo kdykoli vypov\u011bd\u011bt bez v\u00fdpov\u011bdn\u00ed doby smlouvu nebo od smlouvy odstoupit z d\u016fvodu podstatn\u00e9ho poru\u0161en\u00ed povinnost\u00ed Ubytovatele a v dal\u0161\u00edch p\u0159\u00edpadech dle VOP za podm\u00ednek uveden\u00fdch v t\u011bchto VOP, Smlouv\u011b o ubytov\u00e1n\u00ed nebo pr\u00e1vn\u00edch p\u0159edpisech \u010cesk\u00e9 republiky.\r\n\u2022 pr\u00e1vo p\u00edsemn\u011b ozn\u00e1mit Ubytovateli, \u017ee se nam\u00edsto n\u011bho z\u00fa\u010dastn\u00ed Ubytov\u00e1n\u00ed dle Smlouvy o ubytov\u00e1n\u00ed jin\u00e1 osoba za podm\u00ednky, \u017ee v takov\u00e9mto ozn\u00e1men\u00ed bude sou\u010dasn\u011b prohl\u00e1\u0161en\u00ed t\u00e9to osoby (nov\u00e9ho Klienta), \u017ee souhlas\u00ed s ubytov\u00e1n\u00edm, slu\u017ebami a jejich cenou uveden\u00fdmi ve Smlouv\u011b o ubytov\u00e1n\u00ed a \u017ee spl\u0148uje ve\u0161ker\u00e9 podm\u00ednky k \u00fa\u010dasti na Ubytov\u00e1n\u00ed, jsou-li vy\u017eadov\u00e1ny. P\u016fvodn\u00ed a nov\u00fd Klient spole\u010dn\u011b a nerozd\u00edln\u011b odpov\u00eddaj\u00ed za uhrazen\u00ed celkov\u00e9 ceny uveden\u00e9 dle Smlouvy o ubytov\u00e1n\u00ed a administrativn\u00edch \u010di jin\u00fdch n\u00e1klad\u016f, kter\u00e9 Ubytovateli vzniknou v souvislosti se zm\u011bnou Klienta.\r\n\u2022 pr\u00e1vo na reklamaci chybn\u011b nebo nekvalitn\u011b poskytnut\u00e9ho ubytov\u00e1n\u00ed \u010di slu\u017eeb a jejich vy\u0159\u00edzen\u00ed v souladu s t\u011bmito VOP.\r\n\u2022 pr\u00e1vo na ochranu osobn\u00edch \u00fadaj\u016f a jin\u00fdch dat t\u00fdkaj\u00edc\u00edch se Klienta a spolucestuj\u00edc\u00edch osob.\r\n7.2 Z\u00e1kladn\u00edmi povinnostmi Klienta jsou zejm\u00e9na:\r\n\u2022 povinnost \u00fapln\u011b a pravdiv\u011b vyplnit Rezervaci, p\u0159\u00edpadn\u00e9 p\u0159ilo\u017een\u00e9 formul\u00e1\u0159e nutn\u00e9 k poskytnut\u00ed Ubytov\u00e1n\u00ed a p\u0159edlo\u017eit p\u0159i n\u00e1stupu na Ubytov\u00e1n\u00ed pot\u0159ebn\u00e9 doklady k identifikaci Klienta a spolucestuj\u00edc\u00edch osob (platn\u00fd ob\u010dansk\u00fd pr\u016fkaz, platn\u00fd cestovn\u00ed pas) a p\u0159\u00edpadn\u011b bez zbyte\u010dn\u00e9ho odkladu ozn\u00e1mit zm\u011bnu t\u011bchto \u00fadaj\u016f.\r\n\u2022 vyplnit a podepsat registra\u010dn\u00ed kartu p\u0159i registraci k ubytov\u00e1n\u00ed.\r\n\u2022 povinnost nahl\u00e1sit Ubytovateli p\u0159\u00edpadnou \u00fa\u010dast ciz\u00edch st\u00e1tn\u00edch p\u0159\u00edslu\u0161n\u00edk\u016f.\r\n\u2022 povinnost nahl\u00e1sit Ubytovateli zm\u011bnu po\u010dtu osob u\u017e\u00edvaj\u00edc\u00edch objekt a v p\u0159\u00edpad\u011b souhlasu Ubytovatele s touto zm\u011bnou, zapsat je do knihy ubytovan\u00fdch na recepci Ubytovatele a uhradit za takto neuveden\u00e9 osoby v Rezervaci cenu Ubytov\u00e1n\u00ed dle cen\u00edku Ubytovatele. V p\u0159\u00edpad\u011b p\u0159ekro\u010den\u00ed maxim\u00e1ln\u00edho povolen\u00e9ho po\u010dtu osob pro dan\u00fd objekt a\/nebo poru\u0161en\u00ed povinnosti nahl\u00e1sit osoby neuveden\u00e9 v Rezervaci a u\u017e\u00edvaj\u00edc\u00ed objekt, je Ubytovatel opr\u00e1vn\u011bn odstoupit od smlouvy pro jej\u00ed podstatn\u00e9 poru\u0161en\u00ed a klienta, osoby ho prov\u00e1zej\u00edc\u00ed a dal\u0161\u00ed osoby z Ubytov\u00e1n\u00ed vyk\u00e1zat, p\u0159i\u010dem\u017e t\u00edm se ztr\u00e1c\u00ed n\u00e1rok na poskytnut\u00ed ve Smlouv\u011b o ubytov\u00e1n\u00ed uveden\u00e9ho Ubytov\u00e1n\u00ed stejn\u011b jako n\u00e1rok na n\u00e1hradu uhrazen\u00e9ho a nevy\u010derpan\u00e9ho Ubytov\u00e1n\u00ed.\r\n\u2022 povinnost uhradit Ubytovateli cenu Ubytov\u00e1n\u00ed s platebn\u00edmi podm\u00ednkami uveden\u00fdmi ve Smlouv\u011b o ubytov\u00e1n\u00ed a v souladu s t\u011bmito VOP a prok\u00e1zat jej\u00ed zaplacen\u00ed na z\u00e1klad\u011b v\u00fdzvy Ubytovatele.\r\n\u2022 povinnost uhradit Ubytovateli storno-poplatek v p\u0159\u00edpadech uveden\u00fdch v t\u011bchto VOP.\r\n\u2022 povinnost p\u0159evz\u00edt od Ubytovatele doklady nutn\u00e9 k \u010derp\u00e1n\u00ed Ubytov\u00e1n\u00ed.\r\n\u2022 povinnost dostavit se ve stanoven\u00e9m \u010dase na m\u00edsto \u010derp\u00e1n\u00ed Ubytov\u00e1n\u00ed.\r\n\u2022 povinnost \u0159\u00eddit se pokyny zam\u011bstnanc\u016f Ubytovatele, ubytovac\u00edmi a jin\u00fdmi provozn\u00edmi \u0159\u00e1dy Ubytovatele vydan\u00fdmi pro \u010derp\u00e1n\u00ed a poskytov\u00e1n\u00ed ubytov\u00e1n\u00ed a \u010derp\u00e1n\u00ed slu\u017eeb v jednotliv\u00fdch resortech Amenity Resorts. V p\u0159\u00edpad\u011b, kdy Klient nebo osoby ho prov\u00e1zej\u00edc\u00ed i p\u0159es v\u00fdstrahu hrub\u011b poru\u0161uj\u00ed povinnosti vypl\u00fdvaj\u00edc\u00ed ze Smlouvy o ubytov\u00e1n\u00ed, t\u011bchto VOP nebo p\u0159edpis\u016f (\u0159\u00e1d\u016f) Ubytovatele, pr\u00e1vn\u00edch p\u0159edpis\u016f \u010di dobr\u00e9 mravy nebo naru\u0161uj\u00ed program \u010di \u010derp\u00e1n\u00ed ubytov\u00e1n\u00ed a slu\u017eeb jin\u00fdch klient\u016f Ubytovatele, je Ubytovatel opr\u00e1vn\u011bn Klienta a osoby ho prov\u00e1zej\u00edc\u00ed z ubytov\u00e1n\u00ed \u010di \u010derp\u00e1n\u00ed slu\u017eeb vyk\u00e1zat (vypov\u011bd\u011bt Smlouvu o ubytov\u00e1n\u00ed bez v\u00fdpov\u011bdn\u00ed doby), p\u0159i\u010dem\u017e tento ztr\u00e1c\u00ed n\u00e1rok na poskytnut\u00ed ve Smlouv\u011b o ubytov\u00e1n\u00ed sjednan\u00e9ho Ubytov\u00e1n\u00ed, stejn\u011b jako n\u00e1rok na n\u00e1hradu uhrazen\u00e9ho a nevy\u010derpan\u00e9ho Ubytov\u00e1n\u00ed.\r\n\u2022 povinnost Klienta a osob ho prov\u00e1zej\u00edc\u00edch chovat se tak, aby sv\u00fdm chov\u00e1n\u00edm nenaru\u0161ovali \u010di neomezovali \u010derp\u00e1n\u00ed ubytov\u00e1n\u00ed a\/nebo slu\u017eeb jin\u00fdch klient\u016f Ubytovatele.\r\n\u2022 povinnost uhradit \u0161kodu na majetku Ubytovatele, kterou mu zp\u016fsobil s\u00e1m, osoby ho prov\u00e1zej\u00edc\u00ed \u010di jin\u00e9 osoby a\/nebo jeho dom\u00e1c\u00ed zv\u00ed\u0159e, kter\u00fdm zavin\u011bn\u011b umo\u017enil p\u0159\u00edstup k majetku Ubytovatele.\r\n\u2022 povinnost p\u0159i Rezervaci uv\u00e9st, \u017ee popt\u00e1v\u00e1 objekt, kde je ubytov\u00e1n\u00ed mo\u017en\u00e9 s dom\u00e1c\u00edm zv\u00ed\u0159etem a jejich p\u0159\u00edpadn\u00fd po\u010det. V p\u0159\u00edpad\u011b, \u017ee tak Klient neu\u010din\u00ed, je Ubytovatel z d\u016fvodu, \u017ee pro ubytov\u00e1n\u00ed klient\u016f s dom\u00e1c\u00edmi zv\u00ed\u0159aty je ur\u010den pouze omezen\u00fd po\u010det objekt\u016f, respektive v n\u011bkter\u00fdch resortech nen\u00ed ubytov\u00e1n\u00ed s dom\u00e1c\u00edmi zv\u00ed\u0159aty v\u016fbec povoleno a nebude-li mo\u017en\u00e9 Klientovi z d\u016fvodu vy\u010derp\u00e1n\u00ed kapacit poskytnout takov\u00fdto objekt, opr\u00e1vn\u011bn odm\u00edtnout Klienta ubytovat a od Smlouvy o ubytov\u00e1n\u00ed odstoupit, p\u0159i\u010dem\u017e tento ztr\u00e1c\u00ed n\u00e1rok na poskytnut\u00ed ve Smlouv\u011b o ubytov\u00e1n\u00ed sjednan\u00e9ho Ubytov\u00e1n\u00ed, stejn\u011b jako n\u00e1rok na n\u00e1hradu uhrazen\u00e9ho a nevy\u010derpan\u00e9ho Ubytov\u00e1n\u00ed , nedohodnou-li se smluvn\u00ed strany jinak.\r\n\u2022 povinnost Klienta doplatit Ubytovateli rozd\u00edl ceny Ubytov\u00e1n\u00ed po slev\u011b uveden\u00e9 v Rezervaci v p\u0159\u00edpad\u011b, \u017ee Klient neprok\u00e1\u017ee Ubytovateli spln\u011bn\u00ed podm\u00ednek pro poskytnut\u00ed slevy z ceny Ubytov\u00e1n\u00ed.\r\n\u2022 Klient (a\u0165 u\u017e jako fyzick\u00e1 osoba nebo pr\u00e1vnick\u00e1 osoba) odpov\u00edd\u00e1 za dodr\u017eov\u00e1n\u00ed povinnost\u00ed vypl\u00fdvaj\u00edc\u00edch ze Smlouvy o ubytov\u00e1n\u00ed, t\u011bchto VOP, ubytovac\u00edch a provozn\u00edch \u0159\u00e1d\u016f ubytovatele a pr\u00e1vn\u00edch p\u0159edpis\u016f \u010cesk\u00e9 republiky ze strany fyzick\u00fdch osob uveden\u00fdch v Potvrzen\u00ed rezervace a\/nebo ho prov\u00e1zej\u00edc\u00edch.\r\n7.3 Podrobn\u011bj\u0161\u00ed \u00fapravu pr\u00e1v a povinnost\u00ed obsahuj\u00ed ubytovac\u00ed a jin\u00e9 provozn\u00ed \u0159\u00e1dy jednotliv\u00fdch resort\u016f, je\u017e jsou ve\u0159ejn\u011b dostupn\u00e9 klient\u016fm v jednotliv\u00fdch resortech.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek VIII.<\/strong>\r\n<strong>Reklamace a informace o mimosoudn\u00edm \u0159e\u0161en\u00ed spor\u016f<\/strong><\/p>\r\n<p style=\"text-align: left;\">8.1 Klient je opr\u00e1vn\u011bn reklamovat u Ubytovatele kvalitu poskytnut\u00e9ho ubytov\u00e1n\u00ed a\/nebo slu\u017eeb, pokud jejich kvalita \u010di rozsah nebo jin\u00e9 podm\u00ednky neodpov\u00eddaj\u00ed rozsahu, kvalit\u011b a podm\u00ednk\u00e1m uveden\u00fdm ve Smlouv\u011b o ubytov\u00e1n\u00ed. Ubytovatel se zavazuje bez zbyte\u010dn\u00e9ho odkladu zjistit okolnosti reklamace a v p\u0159\u00edpad\u011b opr\u00e1vn\u011bn\u00e9 reklamace zabezpe\u010dit n\u00e1pravu vadn\u00e9ho stavu \u010di Klientovi poskytnout slevu. Reklamaci je Klient povinen uplatnit u Ubytovatele bez zbyte\u010dn\u00e9ho odkladu po tom, co zjist\u00ed vadn\u00e9 poskytnut\u00ed. Na pozd\u011bj\u0161\u00ed reklamace nebude br\u00e1n z\u0159etel.\r\n8.2 Informace o mimosoudn\u00edm \u0159e\u0161en\u00ed spor\u016f- Subjektem p\u0159\u00edslu\u0161n\u00fdm pro mimosoudn\u00ed \u0159e\u0161en\u00ed spor\u016f (ADR) mezi provozovatelem a klientem vypl\u00fdvaj\u00edc\u00edch z poskytov\u00e1n\u00ed ubytov\u00e1n\u00ed a s t\u00edm souvisej\u00edc\u00edch slu\u017eeb (spot\u0159ebitelsk\u00e9 spory) je dle \u00a7 20e p\u00edsm. d) z\u00e1kona \u010d. 634\/1992 Sb., o ochran\u011b spot\u0159ebitele, ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f, \u010cesk\u00e1 obchodn\u00ed inspekce, se s\u00eddlem \u0160t\u011bp\u00e1nsk\u00e1 567\/15, 120 00 Praha 2, I\u010c 00020869, internetov\u00e1 adresa: http:\/\/www.coi.cz\/ nebo jin\u00fd subjekt pov\u011b\u0159en\u00fd Ministerstvem pr\u016fmyslu a obchodu.<\/p>\r\n&nbsp;\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek IX.<\/strong>\r\n<strong>Ostatn\u00ed ustanoven\u00ed<\/strong><\/p>\r\n<p style=\"text-align: left;\">9.1 Ubytov\u00e1n\u00ed Klienta ze strany Ubytovatele je mo\u017en\u00e9 nejd\u0159\u00edve od 16:00 hod. dne uveden\u00e9ho v Rezervaci jako prvn\u00ed den ubytov\u00e1n\u00ed. Klient je povinen p\u0159edat vyklizen\u00fd objekt v posledn\u00ed den ubytov\u00e1n\u00ed uveden\u00fd ve Smlouv\u011b o ubytov\u00e1n\u00ed nejpozd\u011bji do 10:00 hod. V p\u0159\u00edpad\u011b prodlen\u00ed s p\u0159ed\u00e1n\u00edm vyklizen\u00e9ho objektu Klientem, je Ubytovatel opr\u00e1vn\u011bn \u00fa\u010dtovat Klientovi za ka\u017edou zapo\u010datou hodinu prodlen\u00ed s p\u0159ed\u00e1n\u00edm vyklizen\u00e9ho objektu smluvn\u00ed pokutu ve v\u00fd\u0161i 500,- K\u010d (slovy: p\u011bt set korun \u010desk\u00fdch). T\u00edm nen\u00ed dot\u010deno pr\u00e1vo Ubytovatele na n\u00e1hradu \u0161kody v pln\u00e9 v\u00fd\u0161i.\r\n9.2 Nabude-li Ubytovatel d\u016fvodn\u00e9 podez\u0159en\u00ed, \u017ee Klient u\u017e\u00edv\u00e1 objekt v rozporu s podm\u00ednkami Smlouvy o ubytov\u00e1n\u00ed \u010di v rozporu s ubytovac\u00edmi nebo provozn\u00edmi \u0159\u00e1dy Ubytovatele nebo v rozporu s ve\u0159ejn\u00fdm po\u0159\u00e1dkem, je Ubytovatel opr\u00e1vn\u011bn vstoupit do objektu a vykonat kontrolu jeho u\u017e\u00edv\u00e1n\u00ed.\r\n9.3 Ubytovatel neodpov\u00edd\u00e1 za \u0161kody vznikl\u00e9 na funk\u010dnosti elektrick\u00fdch \u010di elektronick\u00fdch za\u0159\u00edzen\u00edch Klienta a d\u00e1le za p\u0159\u00edpadn\u00e9 omyly \u010di nespr\u00e1vn\u011b poskytnut\u00e9 informace o akc\u00edch \u010di poskytovan\u00fdch slu\u017eb\u00e1ch ze strany jin\u00fdch osob.\r\n9.4 Klient, kter\u00fd se ubytuje p\u0159ed 6:00 hod. (\u0161estou) rann\u00ed, plat\u00ed sazbu za celou p\u0159edch\u00e1zej\u00edc\u00ed noc.\r\n9.5 \u017d\u00e1dn\u00e1 parkovac\u00ed plocha jednotliv\u00fdch resort\u016f Amenity Resorts, v\u010detn\u011b gar\u00e1\u017e\u00ed, nen\u00ed hl\u00eddan\u00fdm parkovi\u0161t\u011bm nebo hl\u00eddanou gar\u00e1\u017e\u00ed a ubytovatel ani neposkytuje jak\u00fdkoli dohled nad zaparkovan\u00fdmi vozidly klient\u016f a\/nebo jejich p\u0159\u00edslu\u0161enstv\u00edm.\r\n9.6 Za\u0161krtnut\u00edm pole \u201eSouhlas\u00edm se zas\u00edl\u00e1n\u00edm obchodn\u00edch sd\u011blen\u00ed prost\u0159ednictv\u00edm elektronick\u00fdch prost\u0159edk\u016f dle z\u00e1kona \u010d. 480\/2004 Sb. a zpracov\u00e1n\u00edm osobn\u00edch \u00fadaj\u016f pro tyto \u00fa\u010dely\u201c v rezerva\u010dn\u00edm formul\u00e1\u0159i Ubytovatele um\u00edst\u011bn\u00e9m na webov\u00e9 str\u00e1nce www.amenity.cz (d\u00e1le jen \u201eRezerva\u010dn\u00ed formul\u00e1\u0159\u201c) a jeho odesl\u00e1n\u00edm (p\u0159\u00edpadn\u011b nen\u00ed-li Smlouva o ubytov\u00e1n\u00ed uzav\u0159ena prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele um\u00edst\u011bn\u00e9ho na www.amenity.cz pak jin\u00fdm v\u00fdslovn\u00fdm a prokazateln\u00fdm projevem jeho v\u016fle Klient:\r\n(i) potvrzuje, \u017ee ve\u0161ker\u00e9 osobn\u00ed \u00fadaje uveden\u00e9 v Rezerva\u010dn\u00edm formul\u00e1\u0159i (\u010di jin\u00e9m prokazateln\u00e9m projevu jeho v\u016fle obsahuj\u00edc\u00edm po\u017eadovan\u00e9 informace, nen\u00ed-li Smlouva o ubytov\u00e1n\u00ed uzav\u0159ena prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele) jsou pravdiv\u00e9 a spr\u00e1vn\u00e9, \u017ee byl pou\u010den o sv\u00fdch pr\u00e1vech souvisej\u00edc\u00edch se spr\u00e1vou a zpracov\u00e1n\u00edm jeho osobn\u00edch \u00fadaj\u016f, zejm\u00e9na o tom, \u017ee m\u00e1 pr\u00e1va dle na\u0159\u00edzen\u00ed Evropsk\u00e9ho parlamentu a Rady (EU) \u010d. 2016\/679 o ochran\u011b fyzick\u00fdch osob v souvislosti se zpracov\u00e1n\u00edm osobn\u00edch \u00fadaj\u016f a o voln\u00e9m pohybu t\u011bchto \u00fadaj\u016f a o zru\u0161en\u00ed sm\u011brnice 95\/46\/ES (obecn\u00e9 na\u0159\u00edzen\u00ed o ochran\u011b osobn\u00edch \u00fadaj\u016f) (d\u00e1le jen \u201eNa\u0159\u00edzen\u00ed\u201c) \u2013 vz\u00edt souhlas kdykoliv zp\u011bt, po\u017eadovat po Ubytovateli jako spr\u00e1vci \u00fadaj\u016f informaci, jak\u00e9 jeho osobn\u00ed \u00fadaje zpracov\u00e1v\u00e1, \u017e\u00e1dat si kopii t\u011bchto \u00fadaj\u016f, vy\u017e\u00e1dat si u Ubytovatele p\u0159\u00edstup k t\u011bmto \u00fadaj\u016fm a tyto nechat aktualizovat nebo opravit, pop\u0159\u00edpad\u011b po\u017eadovat omezen\u00ed zpracov\u00e1n\u00ed, po\u017eadovat po Ubytovateli v\u00fdmaz t\u011bchto osobn\u00edch \u00fadaj\u016f, na p\u0159enositelnost \u00fadaj\u016f, podat st\u00ed\u017enost u \u00da\u0159adu pro ochranu osobn\u00edch \u00fadaj\u016f nebo se obr\u00e1tit na soud. resp. sezn\u00e1mil se s obsahem Z\u00e1sad zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f a k obchodn\u00edm sd\u011blen\u00edm, kter\u00e9 jsou k dispozici na webov\u00e9 str\u00e1nce www.amenity.cz a v Rezerva\u010dn\u00edm formul\u00e1\u0159i, a\r\n(ii) ud\u011bluje na z\u00e1klad\u011b p\u0159edchoz\u00edho pou\u010den\u00ed sv\u016fj souhlas:\r\n\u2022 se zpracov\u00e1n\u00edm sv\u00fdch osobn\u00edch \u00fadaj\u016f ve smyslu Na\u0159\u00edzen\u00ed Ubytovatelem jako spr\u00e1vcem, p\u0159\u00edpadn\u011b dal\u0161\u00edmi osobami, se kter\u00fdmi jako zpracovatelem Ubytovatel uzav\u0159e p\u0159\u00edslu\u0161nou smlouvu dle Na\u0159\u00edzen\u00ed, v\u010detn\u011b zp\u0159\u00edstupn\u011bn\u00ed a p\u0159ed\u00e1n\u00ed poskytnut\u00fdch \u00fadaj\u016f t\u011bmto zpracovatel\u016fm a osob\u00e1m dle spolupracuj\u00edc\u00edm s Ubytovatelem na z\u00e1klad\u011b smlouvy ve smyslu Na\u0159\u00edzen\u00ed, a to\r\no v rozsahu \u00fadaj\u016f jeho jm\u00e9na, p\u0159\u00edjmen\u00ed, adresy, \u010d\u00edsla telefonu a e-mailov\u00e9 adresy j\u00edm uveden\u00fdch v Rezerva\u010dn\u00edm formul\u00e1\u0159i (\u010di jin\u00e9m prokazateln\u00e9m projevu jeho v\u016fle obsahuj\u00edc\u00edm tuto informaci, nen\u00ed-li Smlouva o ubytov\u00e1n\u00ed uzav\u0159ena prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele\r\no na dobu neur\u010ditou, resp. do odvol\u00e1n\u00ed \u010di odm\u00edtnut\u00ed jeho souhlasu, resp. vysloven\u00ed jeho nesouhlasu,\r\no pro \u00fa\u010dely obchodn\u00ed a marketingov\u00e9, zejm. nab\u00edzen\u00ed obchodu, slu\u017eeb, produkt\u016f a informov\u00e1n\u00ed o elektronick\u00fdch prost\u0159edk\u016f dle z\u00e1kona \u010d.480\/2004 Sb. o n\u011bkter\u00fdch slu\u017eb\u00e1ch informa\u010dn\u00ed spole\u010dnosti a o zm\u011bn\u011b n\u011bkter\u00fdch z\u00e1kon\u016f ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f (d\u00e1le p\u0159\u00edpadn\u011b jen \u201eZ\u00e1kon o slu\u017eb\u00e1ch IS\u201c);\r\n\u2022 s prost\u0159ednictv\u00edm elektronick\u00fdch prost\u0159edk\u016f Ubytovatelem a t\u0159et\u00edmi osobami uveden\u00fdmi v p\u0159edchoz\u00edm odstavci), kter\u00e1 budou zahrnovat obchodn\u00ed sd\u011blen\u00ed t\u00fdkaj\u00edc\u00ed se v\u00fdrobk\u016f, slu\u017eeb, produkt\u016f a aktivit jak ubytovatele, tak t\u0159et\u00edch osob uveden\u00fdch v p\u0159edchoz\u00edm odstavci.\r\n9.8 Za\u0161krtnut\u00edm pole \u201eSouhlas\u00edm s v\u0161eobecn\u00fdmi obchodn\u00edmi podm\u00ednkami\u201c v Rezerva\u010dn\u00edm formul\u00e1\u0159i a jeho odesl\u00e1n\u00edm (p\u0159\u00edpadn\u011b nen\u00ed-li Smlouva o ubytov\u00e1n\u00ed uzav\u0159ena prost\u0159ednictv\u00edm rezerva\u010dn\u00edho syst\u00e9mu Ubytovatele pak jin\u00fdm v\u00fdslovn\u00fdm a prokazateln\u00fdm projevem jeho souhlasu s VOP) Klient potvrzuje, \u017ee se sezn\u00e1mil s obsahem Z\u00e1sad zpracov\u00e1n\u00ed osobn\u00edch \u00fadaj\u016f a k obchodn\u00edm sd\u011blen\u00edm, kter\u00e9 jsou k dispozici na webov\u00e9 str\u00e1nce www.amenity.cz a byl tak ve smyslu Na\u0159\u00edzen\u00ed pou\u010den o sv\u00fdch pr\u00e1vech souvisej\u00edc\u00edch se spr\u00e1vou a zpracov\u00e1n\u00edm jeho osobn\u00edch \u00fadaj\u016f.<\/p>\r\n<p style=\"text-align: center;\"><strong>\u010cl\u00e1nek X.<\/strong>\r\n<strong>Z\u00e1v\u011bre\u010dn\u00e1 ustanoven\u00ed<\/strong><\/p>\r\n<p style=\"text-align: left;\">10.1 Tyto VOP ve smyslu \u00a7 1751 a n\u00e1sl. ob\u010dansk\u00e9ho z\u00e1kon\u00edku upravuj\u00ed postup p\u0159i uzav\u00edr\u00e1n\u00ed, tvo\u0159\u00ed obsah a jsou ned\u00edlnou sou\u010d\u00e1st\u00ed smlouvy o ubytov\u00e1n\u00ed, uzav\u0159en\u00e9 mezi Klientem a Ubytovatelem.\r\n10.2 Je-li v t\u011bchto VOP po\u017eadov\u00e1na p\u00edsemn\u00e1 forma pr\u00e1vn\u00edho jedn\u00e1n\u00ed, pova\u017euje se za dodr\u017een\u00ed t\u00e9to formy, je-li pr\u00e1vn\u00ed jedn\u00e1n\u00ed u\u010din\u011bno formou dopisu, faxem nebo e-mailem.\r\n10.3 Pokud jak\u00e9koli jednotliv\u00e9 ustanoven\u00ed t\u011bchto VOP bude shled\u00e1no jako neplatn\u00e9, je pln\u011b odd\u011bliteln\u00fdm od ostatn\u00edch ustanoven\u00ed t\u011bchto VOP a takov\u00e1 neplatnost nebude m\u00edt \u017e\u00e1dn\u00fd vliv na platnost a vymahatelnost jak\u00fdchkoliv ostatn\u00edch ustanoven\u00ed t\u011bchto VOP.\r\n10.4 V ostatn\u00edch ot\u00e1zk\u00e1ch neupraven\u00fdch t\u011bmito VOP se Klient a Ubytovatel zavazuj\u00ed \u0159\u00eddit pr\u00e1vn\u00edmi p\u0159edpisy \u010cesk\u00e9 republiky, dobr\u00fdmi mravy a zvyklostmi v oblasti poskytov\u00e1n\u00ed ubytovac\u00edch slu\u017eeb a p\u0159\u00edpadn\u00e9 spory \u0159e\u0161it p\u0159ednostn\u011b
